Ebay problem
I need your advice guys....
I sold some lotus elise brake disks and pads on ebay a few weeks back. I thought they where worth penuts but they sold for £184 as they are apperently rare as hell!!
Anyway, the seller came and inspected the disks, handed over the money and left happy.
Ten days later he emails me saying they are not the disks he thought they where and asked what I thought!!
I told him I thought they where the correct disks as the came off a car with a known service history (these where the orignal brakes).
So he's opened an ebay "not as described" case!!!!!
What do I do? I sold them in good faith - he calims they arnt what he wanted to buy....

if they werent what he wanted to buy he should have walked away at the time of purchase, accept the negative feedback and then respond to it explaining the situation.
State that he should have walked away at the time if he wasnt happy, ebay will take that into consideration

They SHOULD be the correct ones as the car they came of had a fully documented history (all 25k miles of it) and they ONLY resons they where removed was to get rid of the MMC type disks as they are crap on track! Why would someone pay £600 to replace these "special" disks otherwise?

you ain't halfords, or tesco, or john lewis where peole can say "sorry, bought as a presant, don't fit" and get your money back
if you've already told him to like it or lump it then fine, otherwise offer to refund his money, - 30% handling commision and he'll have to come and return the items in as good a condition as they were originally or no deal
but if you don't mind having a dirty consience tell him to get fucked

WOW I nearly spat my tea all over my keyboard reading your responce Will
how many time have we all seen you on here shouitng from from the tree tops, theres no such thing as sold as seen and PMing people to give them advice on how to take people to court
so which is it Will,as you seem to have changed your tune
sold as seen or a millions years warranty
I think I will save this responce just to remind you next time you offer your advice on how to reclaim your money.
AlexF
for the record the guy came and inspected he was happy at the time,so its his fault but then again you are a trader which in Wills eyes will always make you wrong

In this instance, the item being sold is clearly off the car it should be, the bloke came and checked them, and was happy. If they were warped to fuck on fitting then he has a right to ask for a refund as there is no way of checking them easily without special equiptment or fitting them to the car.
Bit different to selling someone a bent crank thats meant to be mint, for top money without even taking it to the engineering shop to get checked and polished, which costs about £10 to make sure you are not selling junk
Seems 95% of the people agree on this thread that Alex is well in the right. If I came to you and bought 2wd brake discs, then tried to fit them to a 4x4, i'm sure you would tell me or anyone else where to go if they asked for thier money back?

As said, whatever mate, you are still sore at being proven wrong, just let it go ... you were wrong, you sold shit. At least you sorted it out (after much hassle), I thought we were cool after the 2 hour phone conversation, but obviously you still have a grudge to bear...... up to you

I am sure on your posts I have said you were right for not giving a refund. It depends on circumstance, as you well know it's not a black and white subject is it?

See Pete, I don't hate traders, they have as much right to buyer protection as anyone.
