Default CCJ form a nudged bumper

A month ago I was informed by my insurance comp that I had run into a third party at a junction. This was alledged to have happened in March this year. I refused to except any liability as I remember the run in I had with her and no damage was caused to which I have sent many letters to my insurance comp telling them this.

Three weeks ago I received paper work from the third parties solicitor telling me that because no head way had been made with my insurance comp that they would be serving legal procedings against me and to expect some court paper work and to forward it on to my insurcance comp (which I got and sent off the following day) One week later I recieved from the court a Judgement for Claiment saying she had won the case and I needed to send her solicitor a cheque for x amount. I forwarded this letter onto my insurance comp as they asked me to when I called them to let them know what I had recieved. They told me that they sent off the defence paper work but the 'other sides' solicitors said they never received it. They eventually found it and agreed that they would allow an overturn of the ruling for my insurance comp to re-submit the paperwork again.

Today I got in and opened up my mail to find 2 letters from various credit/dept ppl saying that I had a CCJ registered against me and they could help me with debt etc. I was shocked as I have a perfect credit history etc so I called them and found out that this CCJ is to do with this accident.

I am so angry and sick with worry that this will ruin me financially.

I know there are ppl who use this board that have had dealings with insurance companies and legal matters etc and I was wondering what advice you could offer me apart from having a go at my insurance company!!!

contact , experian . They are a credit reference agency and they will be able to supply you with a copy of your credit history , it will show any info or dealings you have had with credit companies . if it shows up on there score you can contact them and they will advise you on your best route .
alternativly you can contact the solicitor that caused the ccj in your name and express your concern in the matter . they are supposed to wipe the slate clean if a matter is cleared up or found to be through no fault of your own .

totally in agreement with Brad on this one. BUT one other thing you CAN do, is write to experian and have a note added to the CCJ that there was no financial connnection etc it was due to an indirect incident, and therefore in light of current credit history should not affect me.

This means when you file is viewed when you apply for credit they will see anoted next to it saying why a CCJ was put next to your name.

you can dispute the ccj with the courts as was set with you not present, the judgement can be put aside, once thats done forward to experian and equifax and they can remove

cal the courts they send out the apropiate form

but then you will have to sort the matter out or chances are they will apply again


but its the real only way to sort the issue

Thanx so much for you imput

In the first instance I will call the court and see if they can send me this form before writing to the referance agencies.

What I want to know now is do I have any legal recourse for this mess as I am fully comp insured and this should never have happened in the first place. It's crossed from being an automotive incident (still being disputed by both sides) pass my insurance onto my personal/financial life which its very bad!

For a start your insurance company should have sent a inspector to inspect the claimed damage to the other persons car.

Then your insurance company should ask you for an accident statement.

Then your insurance company should either dispute it or pay out simple really unless you were uninsured, or have had no contact with your insurance company.

It shouldnt have got as far as a CCJ if you have been incontact with your insurance company

Cheers for your input Andy

I have been in full contact with Admiral since I was notified a month ago. I have filled in their accident form and sent thme about 5 letters etc. I phoned them today and they say I now have to speak to their solicitors directly about this CCJ Monday morning but I want blood as this should never have happened. What is my legal standing, anyone know?

Sounds like your insurance company either couldnt get hold of you are refused to pay out and have left you out in the cold, hence the other person has taken it to county court

Yes - the claiment's insurance company did take it to court because I dispute the accident.

I have spoken to the court themselves and it seems this has happened because Admiral have not put my defence paperwork in on time.

Admiral say they sent the paperwork in so im still no better off.

get back on to admiral and put rocket up their jack Tell them you are going to see seperate solictors becuase you are unhappy with being isseued a CCJ becuase of their conduct reguarding this accident
