Default another question, this time i need a lawyer though

can anyone explain to me what a part 18 request for further information means?

i've had to fill in one regarding the amount of money that goes in and out of my bank accounts, including credit cards etc as well as mortgages and all sorts of loans and the like as per a request from the defendant who hit me up the arse as i was approcahing a set of traffic lights in july 2006

they even want to know how much i paid for a replacement car and when i bought one and every car that i own at the time of the accident


i can't remember myself as i've got about 10 of the fookers all in bits and sorn'd all over the shop

i dont understand why they need to know this?

maybe for a compensation claim?

i'd call a solicitor as i doubt its a legal requirment to fill that out, it'll be his defence team, as he'll be obliged to pay a compensation claim to you, but if its not caused you any financial harm he'll most likely get away with it

dont take my word as set in stone, but i think you not legaly obliged to fill it out, and i wouldnt either

the short version:
he's hit me up the arse
coming up to a set of lights
he then went mad rantin' and a ravin' whoopin' and a hollerin'
then he said "no harm done, let's be on our way as i misjudged the turn"
as he was abou to drive away i said "but you've crumpled th eback end of my car"
and then got teh camera phone out
then he was like "sorry, didn't know the area etc"
called the insurance company when i got home
got a call back from a injruy lawyer sort
"courtesy car not on the policy would you like one?"
"yes please"
2 months later, finally get paid out for the car
still no offer for compo payment for my whiplash
then it's contested
then it's going to court
now they are contesting the cost of the courtsey car saying that i knew it was going to cost a lot and have had the money to fund a replacement car and thus negating the need to have the courtesy car for so long
which is what the soliciter is saying i need to fill the forms in for

i just want to make sure i'm not going to get shafted like iwas last time i got rear ended because the judge belived the other guy had x ray vision and saw me through 50 feet worth of underpass and hit me because i was going faster than he was, even though he said he put the brakes on to slow down for the speed camera that was coming up, clearing indicating that he was speeding at that point in time even though he hit me as we both came onto the slip road together with no other cars in the area only a white van, which the judge said i must have mistaken his black car for

If you'd been paid out and kept the courtesy car you will be liable for the costs.

But thats your legal teams fault/insurance companies fault for bad advice.

When I had my not fault crash I got a car a few days later.. my solicitor who I must say was awesome advised I get the car picked up within a few days of recieving the payment for my written off car as I had funds to replace it.

Once I had funds to buy the car there it was not "fair" (uk law is based on equity and fairness) to have the courtesy car and the other insurers to be footing the bill.

If you had money to replace the car as soon as you had the accident I think that is irrelevant as the money was not ear marked for a car at the time as you had a perfectly servicable one.

apparently it transpires that the cheque was sent by the company that are handling the claim
and, once they sent the cheque they came to collect their courtesy car the same afternoon

so my insurance company hasn't actually done anything other than to pass the claim along to their accident manegement company who are dealing with it

that's about as far as i've been able to work it out and now they want my financial details for the past 3 months prior to the accident and up until i was paid a settlement for the car once they wrote it off

most of this time was due to the thrid party not admiting liability as he didn't tell his insurance company he'd twated me up the arse in his works van

does this scenario make sense to the legal begeals out there who might be doing this sort of thing?

or does it just mean the case dragging on and on, they were supposed to go to court last month as there was a daet set and everything so if they haven't, and i haven't been notificed of any changes, does this mean they've gon ehtere on my behalf or did the other side cave in and bottle it?

i want to ask but, at the same time, don't want to come across as a pleb who doesn't know what the fuck isgoing on lke i should do..............
