Just had my escort cossie took off me by the police, apparently before I bought it someone traded it in for a shogun which turned out to be stolen. This guy has then found this out 5 months later and reported his cossie stolen by deception, so now I'm left with no money and no car and over 10k in debt.

Ain't life a bitch!!

Anyone know how the hell I can get my money back, coz I know for sure I can't afford to lose over 10 grand!!!

Yeah when I bought it I did a HPi check on my fone and obviously it came back clear, the law is an arse, it shouldn't be down to me to give this bloke his money back it should be upto him to get it back from the bloke he bought it off!

I'm not sure if they do when you check it by fone, turned out as well the private plate that was on it when i bought it was taken off 2 months before I got it, yet was still on the car when I bought it, and also it had been repaired down the drivers side, front and rear wing and door, yet my mate has worked on cossies all his life and he couldn't even tell.

 

by law he is in the right i think, however if you HPI'd it then you have a case with them i imagine!!!!

 

The police shouldn't have taken your car as your car is not actually stolen. This is a civil dispute. Definately go and see a solicitor as you are no way to blame for this.

i would contact a solicitor first thing in the morning and find out were you stand then if you are in the right sue him and the police for what they have done, if you are in the wrong check with HPI and take it to the civial claims court because you have just been fucked mate .

Couldn't believe it, I only found out coz I was gonna sue the guy for the value of the private plate it should have had on it, did a HPi check with AA on thursday and it said it had been reported stolen while it was in my custody, its all bollocks if u ask me and I think I shall be suing the police and the twat I bought it off, even if he didn't know about it being nicked, whats to say he hasn't shifted some like this before.

I dont understand how it can be reported stolen. Did you paid for it? , did you have a reciept to say you paid for it?, did you trade a car in when you bought it?

If you paid fully for it and have a reciept for it then the guy doesnt have a leg to stand on and the police have acted illegally

 

I have a receipt for my money, signed and dated with the traders address on it. I paid for it in one go with no trade in. And one thing, I've still got the service history file for the fucker tho! And i'm keeping that! Forgot to mention its had over 10k spent on it in 5 years as well.

To be honest I don't want the car back at all knowing its been in a crash, I just want my money back. I wouldn't mind a nice saff or maybe a 740i bmw for a bit of comfort.

 

Coppers have just said to me that their onto it immediately and the guy I bought it off will be getting a visit very soon. They said hopefully I should get at least my money back for it.

this totally unfair but true

say you had bought a car in good faith ( like this situation) and it had outstanding finace on it by the previous owner, the finance company can legally take the car from you to recover the debt tottaly unfair but totally legal its the innocent person that loses his money and the car, same if its stolen and the prevois owner has been payed out by insurance it then becomes the insurance company property like in this case

talk to solicitors as its in your best interest but dont expect it to be settled quickly it will take months / years to come to a conclusion

The fact it's been in an accident is ittelevent if repaired properly - what's the poing in worrying over something so trivial compared to this kind of mess!

If you paid for it and got receipt etc for it, it's all down to civil dispute, if bought at auction is a different matter anyway

My company deals with this type of situation.

My boss deals with innocent purchaser claims but he is on holiday until Tues 12th. Im sure he can give you some advice free, or will take over the claim on your behalf. I believe he charges about Ł120 plus VAT, but dont quote me on that.

My take on it is this - the title of the car was passed to the person you bought it from by the previous owner. The vendor then passed the title of the vehicle to you. The fact the Shogun then turns out to be stolen is a matter between the previous keeper and the trader.

Think of it this way - if the guy paid cash for the shogun, would he report that stolen?!!! No, he would just have a claim against the trader for selling him a stolen vehicle. He should have HPI'd it. His problem, not yours.

its the trader that owes him the money not you, he cant report it nicked as its not fooking nicked, hes purchased a stolen car, he gots his money back from the trader simple as, its just obviuosly he cant get the money off the trader and so the guy is pulling a fast one hoping it will be resloved

As said the cossie is not stolen, so must be returned to you, the other matter is between the trader and previous owner together with the police.
to put it bluntly the cossie has nothing to do with it only it's value in the transaction between pevious owner and trader.

the bloke who traded it in is in the wrong. thats the law process for ya, its part of a crime ie evidence so the convisgate it, ya will without a doub get it back after a battle as bought good faith etc but thats soooo wrong and very upsetting, i fell for you i truley do

i would say this is your car mate and you should get it back if not the trader should give you your money back, if he can get the car back of you he should give you your money back, you did say the first time that you did a hpi report on it and that it was o.k, get back in touch with who did the report for you and see if thay will send a copy to you so you can take the matter further with your solicitor.
