No point hassleing HPi about it - it ain't a HPi problem.... there's nothing worng with the Cossie, the problem is with the shogun.... The Cos is legit, so the sale of the Cos to you was a legit sale....

It ain't your fault the trader got stiched with the dodgy Shogun, so no reason you should have your Cos yanked....

Get a soliciter - as any half decent one wil lget either your car or your money back and leave the problem with the trader as he should have checked what car he was part-exing was.....

You should get the car back imo!
About 14 years ago when i was trading in cars i bought an RS1600i off a geezer who responded to my "Cars Wanted" advert in the Autotrader. I paid 3.5k in cash for it having done all the hpi checks etc and it coming up clear! I later found out that the car had been bought the day before out of the trader by the bloke i bought it off using a forged bankers draught!! Anyway the police got involved and told me i couldn't do anything with it but i told them to fook off and sold it several weeks later and there was nothing they could do as i was in the right

i know someone that had a s1 r.s turbo 7 year ago the police had taken it of him 3 times but still gave it him back, thay then took it away again and said that it was stolen not long after it was new, after the twats had taken it apart thay found nothing and give it him back with bits missing etc he spent 3 weeks putting it right fook me thay cam back and this time he didnt get the car back at all thay had given it back to the owner as there was no insurance on it at the time it went missing he was then left with Ł4500 out of pocket.

apples is right, you bought it in good faith, its not as if you bought it for a couple of grand (it would then look very dodgy) , you paid a good price,got a written reciept, it has nothing to do with the finance repossesion laws, it might take a bit of time/money/effort but you should get it back, whatever happens dont give it the trader back unless he pays you readies, personally i would sooner have the car rather than the money.ring a solicitor first thing in the morning and tell mih to make sure the police do not give the car to the previous owner,if he gets it then yu could be in for a long haul,
it should not be handed over to anyone until court action has been dealt with, lastly what you dont want is to give the car back to the trader and end up getting paid Ł1 a week. cheers nomad

Doesn't HPi have insurance were, if they report a car to be CLEAR and its not you can get the money back from them?

Mate, you need to go after the trader ASAP, as he is the one thats 10k out of pocket on this deal not you.

the car will come up clear when he did the hpi as the cars histoy is clean so hpi wont pay up as they are write the car is only now not clear because the bloke then reported it stoled 5 months later by deception so hpi did there job properly but hpi should have picked up on the private plate not been on the car when you hpi it did you give the private plate reg if so that shouldnt of even been registerd to you cosworth so how did you get the cosworth details up?? hmm if the private plate wasnt even registerd to the escort cosworth and when you sent the log book of it should have come back in the original reg the car was first registerd wiv there seems a lot of mistakes here

Right, spoke to the FILTH this morning from up north where this disputes goin on, they said its the car they're looking for, and they're sending a vehicle inspector down to view the car and confirm its the same car, and have basically told me to contact a lawyer, don't sound good.

The amount of fuck ups that have happened is unreal, I really can't believe how many things have been missed. If it comes down to it I'll sue the police for negligence or whatever it is, as well as the trader for damages as well, coz this is disgusting.

Theres no way I'm going to sit back and lose 10k+, if they wanna fight about it then they're gonna get one. I can see this turning into a police fuck up myself, if that car is left for months without being turned over then they might as well set it on fire coz the engine will be ruined, and I guarantee that they won't let it warm up and start it every day like I did when I wasn't driving it.

Makes me wanna fuck off to another country it really does, this country is an absolute sess pit.

I'd say HPi are shit and wouldn't give a hornets arse about what they say. I have just bought a car and they told me A, it had finance but couldn't say whether it had been paid off even though(after contacting the company myself) it was paid off 2 months ago, and B they couldn't even find the car under it's current registration as they said it had been changed (private plates) to many times, then changed their minds and said it hadn't registered on the system but they still couldn't bring it up and to phone them next week. I had the fookin log book, MOT and tax disc and the letter from the DVLA confirming the change in my hand. The first and last time I will use HPi. Ł40 down the drain

P.S. bought the car and the bloke is a true gent

Rob - that's bad luck on the Cos but I'm sure you'll get to the bottom of it somehow.

Just one other thing about outstanding vehicle finance (someone mentioned it above). If the seller declares there is no finance on a vehicle and you have that in writing (on a written receipt) and then later it turns out there is still finance on the vehicle, the finance company cannot re-posess it from you. HPI people never tell you that do they? Just as long as you fork out their Ł50 fee....

From the trading standards website:

The Consumer Credit Act 1974 gives 'good title' to the innocent private purchaser of a car which later turns out to be subject to a claim by a finance company because of a previous unpaid hire purchase or conditional sale agreement. This means that the finance company which is claiming the money cannot usually repossess the car against your will.

surely if you have a bill of sale and all the documentation and the car was sold on good faith, then its your car that has been stolen as you are the legal owner!!!!
how can somebody report a vehicle stolen if they do not own it??????
why did the police not contact you to see if your vehicle was stolen as its you that the vehicle is registered to???

why not (as the legal owner) report the vehicle stolen!!! claim from your insurance??? are you covered???? some policies have uninsured loss recovery!!

How have the police stolen it? They have recovered property involved in a fraudulent deal. How does the other guy feel? There will always be losers in this situation

Depending on the time this car was traded in against the shogun or sold to the new owner and him making his claim will determine who legally owns the car.

iThe only way you can legally own this car is; he traded it in sold it to new owner on say monday 25th august, and u bought it say 16th september, all contracts signed and he then claims on say 20th september. You are the current legal owner, however if this car was claimed for before you bought it then its the insurance companies car im afraid.

What will make u better is that he will probably be looking at almost 6years away if he has a criminal record and convicted, the charges he will face are: Theft against you, Fraud against insurance people, Pervertion of course of justice, knowingly making a false statement against police and quite a few other charges which fit into those main catergories.

Right, after 7 months wait and about 2 grand in expenses I finally have her back! I'm well chuffed!!!! Going to fetch her in the morning!!!!!! Woohooooooo! Unfortunately shes gonna be up for sale, first offer of Ł9k gets her with new head gasket, 12 months MOT and 6 Months Tax..... moving onto all things BMW!!!!

Where is your car now, have the police got it???? If so you need to ensure they hold it while it is sorted out,

you need to speak to a solicitor asap. You also need to get the car back. Forget going after cash, you would need to get it off the dealer and that aint going to happen so get the car back abd let the other guy get the cash from the dealer.

I can't see that the car can be reported stolen by deception, get advice and get it now.

when i had my rs turbo i spotted a policeman in a marked astra with a flashlight all over it about 10.30pm and when i went out to him he sped off, two days later someone tried to rob it.

Didn't know that things like this could be done mate, defo speak to a solicitor and get some legal advice, no way can you buy a car for 10k+ and then have it taken from you for something that was beyond your control!

Speak to the Police aswell, make their lives hell with it like they have done with you!
