Default insurance question

when you have to produce your documents on a normal stop, and you take in your insurance details, what information do they have instant access to and what do they check?

Does their system show the company and when the policy started or not or even at what time?

I would imagine the system shows when the policy was started and when it expires, to the minute. It should also show who the company is.

why?

why?
long story BUT...

insurance renewal forms filled out and sent by post. Insurance company didnt get em due to post strike and therefore didnt carry on with policy. i dint know this till i got tugged by the law at 1623pm on Monday. Contacted insurance company who said that cos documents hadt arrived there was nothing they can do. I had insurance in place by 1811pm the same day.

You're insurance should have notfied you by phone call that they havent recived renal. TBF i would start to gather all the information you have as this could leed to a court case to where you could well be fined, and points, normaly 6 points.

How did you send your letter of renaul? i do hope signed for and have the recipt. In theroy its not your duty to contact the insurance company, they should contact you, they are the ones who are the worker and your the customer.

i can only see one way really. And thats to take out insurance before the date of the stop, you need to speak to your insurance as there is alot of loop holes with insurance companys, of course if you need some advice i would speak to a independant insurance company which is www.needtoinsure.co.uk and ask to speak to paul Directly and expaine the problems and i hope he can help you with this problem.

I had a policy cancelled once, it was cancelled on the friday, I was stopped on the saturday, letter arrived on the monday to say it was cancelled. It was due to a cock up with payments. Subsequently I ended up in court for no insurance, argued that I wasn't aware I wasn't insured, produced letter I'd received, ended up getting an absolute discharge as the magistrate said I hadn't 'knowingly' committed the offence.

I was banned because of insurance companys and was in the same boat as you mate.

No to rob your topic but i had taken out a policy online, sorted all the times and dates and over checked it, 3 - 4 times and then had my boss check it. twice, i then called the insurance Ecar and told him i've just taken out insurance and wanted to dubbble check that its now running, car was left at home. I went and got VAILD TAX from a tax office, with of course a cover note and my MOT, drove the car and was stoped by the po po, they said it wasnt insured and as of course it takes 24hours to be put onto the insurance data base, went to the said police sation and they cocked it up, he cocked it up as he re-checked the information to make sure everything was correct, and he imputed the time of the start, as you cant do it online,

in the end it all went to court, i phone the insurance comapny for the phone call record and he told me i cant have this but the police can request it, off i went and spoken to the police again and guess what, they wouldnt supply it, must of been an error they told me,

i was hit with a 100pound fine and a nice 6 points which = to being banned.

i deffo know how it feels dude.

BUT make sure that you cover everything, and make sure you sort out legal advice, as me, and others are not insurance companys or a solictor. get legal advice dude.

shocking that is. Thats my worry, ive got 6 points as it is, and the 3rd year was on TUESDAY and i got tugged on Monday. I am led to believe that any add on points during a 3 year period will lead me to being banned,

If thats the case ill lose mejob as i travel around the uk to Retail outlets.

of course you need to say that in court, but at no means does it work all the time, even though its a vaild reasson, the court will look at it and work it out and then decied. so if he has backup plans then sorted.

I had a similar-ish incident a few years back where I was unknowingly uninsured for a fortnight. I went into the police station for my producer and expained what had happened. They could see that I was insured before, and that I was insured 'now' and that it wasn't my fault. All my other documents were correct and that was that, they let me go.

They 'may' be more understanding than you expect.

It all boils down to whether a "reasonably competent person" would know they were uninsured, this is the criteria, CPS/AOJ are getting a serious kicking from jp's at the mo for stupid cases being brought to court.
The access that the plod have to your insurance provider is EVERYTHING, even down to DOB, whether you have mods declared, whether insured for other cars etc, the only thing they can't have is the actual cost, or arrangement for collecting the sum due(cost of insurance), BUT they do have to be told if you are in default with insurance even if the insurer hasn't pulled plug on policy.

I would gather all previous insurance you have had in the past and any insurance you have now and produce that. Tell them that you have paid for it in the past and why would you be driving without it now. Also you would drive uninsured in your car as any accident would be a huge loss to you. I would put those points forward.

Ok, a few questions.

Is this a renewal?
When did the policy expire?
What insurance company?
Did you get a renewal notice?

I have 10 yrs experience in Insurance and know a fair bit. Let me know the above and i will look into a few things?

well tomorrow is D day- i am in court at 2pm so i guess i will see or not if i get a ban, which means i will lose my job. Got a nice letter from work though to take with me, so tonight im gonna have a few beers and try not to dwell on it too much.

yes luckily.

they accepted my severe hardship claim, which tbh is true and i got a great letter from work. The fine should have been 800 plus 85 costs but cos i have 2 children who i pay csa to, he gave me a reduction so in total is 635 as opposed to 885

The judge was really nice tbh and took into consideration i have 11 years no claims and the fact that the royail mail let me down, but he did make it clear that it was for me to check and not simply assume

as long as they lesson has been lernt (remembering to keep on top of your docs) i'm sure the judge had better things to do than to see anotherhard up driver walking down the road
