It all boils down to whether a "reasonably competent person" would know they were uninsured, this is the criteria, CPS/AOJ are getting a serious kicking from jp's at the mo for stupid cases being brought to court.
The access that the plod have to your insurance provider is EVERYTHING, even down to DOB, whether you have mods declared, whether insured for other cars etc, the only thing they can't have is the actual cost, or arrangement for collecting the sum due(cost of insurance), BUT they do have to be told if you are in default with insurance even if the insurer hasn't pulled plug on policy.
