Default driving 7.5 ton truck...

...whats the rules on this these days? I passed my test in 94 so have catagory c and c1 on my licence. I want to drive our own truck to drop our materials to one off our building sites in England this weekend as our drivers are elsewhere .its on our company insurance and is one of our fleet vehicles but hasn't been used since we bought it 6 months ago....

Sorry but that's all gone now. You need a drivers cpc to drive anything above 3.5 ton if its for hire or reward. If you risk it and get court you could end up in jail.you can drive till the 10th of this month and that's it

C1 plus e I think well that's what's on my licence. If it's being driven for hire and reward then tacho rules and I don't think cpc is in force yet but may be wrong on that one

im one of 4 directors of the company so technically im a part owner of the truck...so im taking my materials down to my employees in my truck....I have nothing other than my driving licence entitlement of C1 and C1E OF 7.5 ton with trailer. its the grey area of hire or reward im wondering if I can get around? truthfully our driver broke his wrist during the week so im stuck for getting the stuff down south that's needed urgently.
obviously with my chequered driving history from my youth I wouldn't like to take a blatantly illegal risk but im less worried if its an argueable grey area?
whats the tenth of this month thing? id be back on the 7th?

If it's anything to do with work I.e your getting paid for it which you will be as your working and your dropping goods to a job for work then you need a tacho.

There is no gray area iver it's a working truck that belongs to a company and is used in connection with it's business so hire and reward. Cpc I don't really know about as I work on then not drive them

I checked on website, if you are delivering goods for your own company use such as materials and it's not your usual job then you don't need a cpc, if you are delivering goods for a customer then you do. If you check on dvla website it makes it clear, you do need a tachograph though. They list some examples to compare to.

Cpc is one big gray area lol we don't need it as mechanics to pick trucks up to work on or to road test. But we may need it to drop them back for reward lol stupid.
No one in are garage has done it

My boss has said that we don't need a cpc as we are delivering our own materials to do a job

I'm a scaffolder

Can't see it working like that. Seems to big a loop hole to me

Correct, the only exception is for people like yourself where by their duty time exceed thier driving time on a daily basis. Unless your are a domestic driver ie work for the council, police or fireman. Other than that your need a drivers cpc to use an lgv. No ifs no buts,.of you keep getting stop and failing to produce you drivers cpc card make no mistake you will go to jail.

I will also add the scaffolders should only go from point a to point b and back, delivering to another site it not permitted. To multi drop and work you will require a drivers cpc.

I don't need a cpc card. im not a driver, its not my main job, its my materials being taken to my site in my truck .
Who is exempt?

Drivers of the following vehicles will not be required to hold a Driver CPC:

•A vehicle carrying material or equipment to be used by that person in the course of his or her work, provided that driving that vehicle is not that person's principal activity.

Are you personally going to be using the materials that your transporting to the site, or are you dropping them off for other members of staff?

You can't do it. You will exceed your duty time.

It's your product, on your lorry being delivered to your customer. You are being paid, therefore profit and reward. Ring the dsa.

Leaving CPC aside,do you have a tacho card? New digital tachos need the driver to insert his own personal card, it isn't a paper disc any more.

Good point, it is a offence to operate and lgv without a digital tacho card. This must he carried at all times even if the vehicle uses apolog discs.

That's only if you have a digi card. If your not issued with one and it's an analog tacho that rule don't apply

Incorrect fella, Vosa pulled me in for a fleet check a few weeks back. Asked for my 28 days of apolog discs and my driver card which I provided. Ł80 plus points for not carrying that.

That will be because you have a digi card! To drive a truck with an older tacho you don't have to have a digi card. So if you have never apply for one how can you carry it

As a professional driver it is your responsibility it insure your have the correct tools to do the job. One of those tools is a digi card.

Its not about applying for the card, it's weather or not you are exempt for having one.

If you have never applied for a digi card and you intend to use that as an excuse I don't think it will wash with the dvsa.

I'm fully awear of the fact you have to carry your digi card at all times while driving a hgv if you have one!
We are talking about someone driving a truck at work to fill in. If it's an analog tacho truck and you don't own a digi tacho there's no problem. Some drivers own there own truck and have older ones that have older tachos and never drive trucks with digi tachos. There's nothing wrong with this and they don't need to have a digi card

I do tachos I work for Adams Morey Daf we see a fair few trucks that belong to people who have never driven with a digi card nor own one. You only need one if you drive a truck with a digi tacho if you don't you don't have to have one.
I still see guys in are place who have been driving for most there life and only just got a card due to a new truck who don't have a clue how to use the newer tachos as they have never used one lol

It's a mine field for drivers and worse for us as that is where the buck stops and 'revenue' is created.

Several months ago we had reps from vosa for a talk at a company conference. They said things are getting massively stricter with the rules and regs but they don't expect the industry to catch up over night.

When asked "so you don't expect the industry to catch up over night but tomorrow you will prosocuted and fine some poor sod and that's ok then?" They didn't have an answer.
Even our MD ripped into them.

It's best to be safe than sorry really lol we see vosa a lot at are place as they come in from time to time to look at are tacho equipment as we fit and calibrate them.
For you don't drive it with out a card in and if it's a company vehicle in works time dropping bits to a customers house it's hire and reward.
Make sure the calibration sticker is in date as well! It needs doing every 2 years on a digital so 2 years from the date shown on the sticker

Just to Chuck a spanner in the works. I'm workshop supervisor in a garage but I occasionally do breakdowns with our 7.5 ton truck. Do I need my cpc. I've got in anyway but would be handy to know so I don't have to do it next time.
