Default Speeding, licence info and advice

Okay guys, I got caught speeding - 95 in a 60, timed over a distance. I have admited it and pleeded guilty by post to the procurator fiscal (It was in Scotland).

The court then sent me a letter back saying that because I already have 6 points, 3 for a sp30 1 year ago and 3 for a sp30 3 years and 1 day ago, that I have to attend court this Thursday due to totting up?

I thought that points on your licence are valid for 3 years for totting up and 4 years till you can remove them from the licence.

So if the court looked beter at the date of conviction surly they would have seen that the 3 points expired the day previous?

Any comments or advise, please.

Guessing an SP30 might be for a speeding offence.?
If so, they're trying to overlook and 'date' rules and shaft you cos you're obviously, as far as they're concerned, a serial speeder.

No offence meant pal, but 95 in a 60........prepare to bend over for at least another 6.

Agree with Brian. 95 in a 60, 3rd offence, just stop speeding before u lose your licence or kill somebody.

You will probably lose your licence I'm afraid to say... if they whack you with a 6... Gutted for you mate but you really need to slow down.

The SP30 was a speed camera, offence and conviction same day 12 sept 2008. My new offence day 6th Aug 2011 with hearing that I pleeded guilty 13 sept 2011.

I just got 3points for another offence an got told itll be of in 3 years by the copper but when looking online its all gone up to four years now

have to agree with that bit rich from people the guy above has a 3dr cosworth so sticks to the speed limits? 95 on a single carriageway is not exactly the same as 65 in a residential 30mph zone.

So owning a cosworth means I speed on the road..?.... Don't get me wrong i hover just above 30 and so on but you don't see me doing 95 in a 60..!.. That's what track days are for I was in ar as a passenger when a girl got runover at 30 she ended up a cabbage..

Me too.

I was on my way to Ford Fair early Saturday morning on a A road. Had been following 3 other cars perfectly happy at 50 mph, but then the 2 mile straigh appered with nothing else on it in either direction so i over took, my car accelerates quite fast and the coppers got me.

Chop, I don't think any of us were meaning we were Saints on the road, but case in point is 60 on an A road is still 60, and 95 is close to 100.

Breaking 100 on the motorway is meant to be a ban, so was only trying to gratify the situation as in due to being an A road, and with previous, it wasn't looking too good.

I agree, from the circumstances added later he's just bloody unlucky

100 is a bit of a myth on the 'automatic ban'. I and 2 friends have all been done between 100 and 110 mph and got 6 points. 110 mph was what the copper/solicitor told me back in 2002/3 when caught.

PS 95 is FA. 166 indicated on a bike is where it's at

You will probably loose your licence regardless. 30mph above the speed limit is usually an instant ban!

95 in a 60? fucking lightweight. 132 in a 60 is were its at
theres lots of myths surrounding motoring offences and "automatic" bans. it could go either way for you. 5 points on a decent day and a reasonable fine to take you to 11 points? depends on the judge but i guarantee you no matter which judge you get someone will have a story to tell about how that particular judge hates speeding offences because their son/daughter/mum/dad etc was killed by a speeding motorist.

You may get a short ban or 6 points. You can reduce the chance of a ban by indicating that you wouldn't be too inconvenienced by it e.g. say you can easily get the bus to work.

I got 6 points and for also doing 95 in a 60 on the A65 to Kirkby Lonsdale on my CBR600 - same scenario - nice long straight, click down into third, pass a load of cars and then a BMW traffic car appears a few minutes later.....

Had to go to court - pleading guilty by post wasn't enough.

the pleading thing can go either way as well. they might decide to make an example to teach you the lesson youve failed to learn on 2 previous occasions regardless of whether you lose your job. "you should have considered that before" they will preach . which way it goes...no one knows .....
best to stuff a few bags of smack up your arse just in case.

Yoy prize will be a speed awareness course, large fine and 6 points. You will keep your license if your soliciter tells the court that you are a hard working business owner and loss of license means loss of business etc. Don't sweat

the "loose your job" excuse doesnt work as well as it used to, especially for a serial offender like you.

if you walk away with your license then youve been a very lucky boy. Theyve every right to give you a ban or 6 points and a totter up ban.

I got 6 points and £600 fine for 104.7mph on the a14. Copper took 8miles to catch up with me he sat right on my bumper it was dark I couldnt see the car and he didnt have the blue lights on I thought it was my mate so dropped it from 5th to 4th and pulled away from him as the car dropped back I looked in the mirror and saw the shadow of the roof lights and realised I was nicked. it could have been a lot worse though

In January I got caught doing 99.75 in a 60, got 6 points. It was only in the Justice of Peace court so wasn't a serious offense, so my solicitor went for me as he said if I'm not there they can't ban me. He did however say if they really did want to ban me they could set another date and request I be there. He said it was better to take the chance that they'd just give me 6 points. Cost me £95 for the solicitor to appear for me.

I use Micheal Lyon Solicitors in Glasgow for any driving issues I have. Very professional service and have saved my licence a couple of times. I highly recommend them. http://www.theroadtrafficlawyer.com

I was accused of dangerous driving, failing to stop and failing to tell them who the driver of the vehicle was. I received 0 points, £0 fine and 0 months ban using these guys. Not guilty verdict. Top work! I did however have to pay them for it lol

I got 7 points for 115 in a 60, moment of madness, tried to ban me but already had 3 points got a reference from my gaffa as i did driving work on the side at the time and just grovelled and walked away with it, £580 fine tho

So still have a licence.
