Default buying a car - deposit question

imagine, if you will, yo ugo and look at a car
you like the car
yuo come to an arrangement with the seller
you leave a deposit
you come back with the rest and a lift to get the car
then you find the cars got a problem

how do you get your deposit back if it's one of them "non refundable deposit" things then?

now, i'm not talking about you've changed your mind or you're skint type of things, i'm talking about the engine being fucked or someones danced on the bonnet and the cars price is still what they expect you to pay

and is it different for private and trade sales?

id walk away with the keys and paperwork and tell him he can have it back when you get deposit back, or something else to the value

It depends whether your on about a dealer or privately. With a dealer it should be quite easy, trade descriptions act iirc. Privately it may be sold as seen, although if it has happened since you left the deposit they should be refunding it because it doesn't fit the original condition you agreed to the sale in. May be hard to prove though and would probably end up in the small claims court.

Depends on the person, if they aint a complete prick im sure you could agree on something like lower the price of what you owe on the vehicle as you will need to sort the problems

did you take a note of the mileage on the first viewing?

I you did and now the mileage has gone up then really you have good argument to back out as a fault has arisen after you viewed it.

How did the fault get spotted but not spotted before?

At the moment it's a hypothetical scenario but it's happened to me in the past so I don't want to get burnt again. Basicly I left a £500 deposit on a car which was mint and when I went back a few days later someone had punctured one of the tyres a d drawn a few large circles on the bonnet. But seeing as I'd paid 60% of the guys original asking price I wasn't really in a position to haggle

The second time around the guy dropped the price from £1500 to £1100 due to a knock from the suspension and he threw in the bits to fix it as well, or so I thought. 2 weeks later when the gearbox blew up and another 2 weeks after that when the thermostat blew up because it was the wrong one I didn't have myself such a bargain. I already knew the guy had put a diddly mot on it as his garage had done the mot and 2 weeks prior to it it had failed on the knock from the suspension and had 40,000 more miles on the clock

I have a feeling I'm about to be riddled again with a "bargain" so have so far been reluctant to place a deposit for what could be a shit heap.

Now all I need to do is ask what optional extras are available from thr main dealer as this 10 plate quattro s-line A4 has before I part with the thick end of £24k for it because that's what the cord dealer reckons he'll give me in part x for a new motor.

personally i think your leaving too larger deposit if it is on a non refundable basis, infact CRAZY amount at £500.

£100 MAX, this is enough for a seller to advertise the car for a month or two should you need to back out, or enough to make it less of a ball ache for them.

Also, 1 week is a long as I would leave between deposit and collection and IF they need to use the car after a deposit has been left (which I would be insistant it was NOT and would take the mileage reading infront of them) then I would make sure my deposit was left on the understanding that if a problem should arise with the car that was not present when the deposit was left, then it would be refunded.

If you and the seller know and agree the deal before money is handed over, there should be little reason to have issues.

If the car goes belly up a day,week,month later, then it is just one of those things you have to accept, the car aint brand new and is not under warranty if bought privately.

the cars been parked up for a few months now and has about 3000 miles on it, i don't know if i'm getting a bargain or not, but it does seem to be the case

just don't want to be shafted on so much money but it's very very tempting

i've just tried to spec it up from what i know and it's a £50k car

thing is though, it's a legit motor, i've gone and hpi'd it and been to the dealer who sold it and everything, but i've got that nagging doubt in the back of my mind

it'll probably be fine for the guy who buys it, but after 3 months of fidgeting, i'll give it a miss as it's a few quid to be out of pocket of if it turns out to b a bit hooky

A £50k motor on a 10 plate for £24K something aint right there...too good to be true...sod that and RUN...
