Default Car clocking question.....

My mate purchased a VW Passat about 3 months ago from a small time car dealer, he got in contact with the previous owner and 100k miles have gone missing from the car!. The car has 80k on it and the last owner sold it with 175k on it!. The car is about 8 years old and is 1 previous owner. Basically what should he do? he has the autotrader with the original ad in and a full reciept.

Any idea?

Pop to the trading standards adn show them the detail and the prior owners details etc

100k on a motor is WEDGE of cash in value , not good

didnt the old MOTS if any show this or the history
(ps i know historys can be created to match mileage)

or call dealer tell him that yoiu know the score and you want X amount of cash or your calling the old bill and trading standards

Did the Trader at any point write on your reciept or put a sticker on the dashboard to state that the mileage could not be verified?

If not, then I think you might be able to do something about it, because as a Trader he is deemed to know better, and as a private buyer you have the law on your side.

But im sure it comes down to whether he stated at any time if he could verify the mileage or not.

Go see your local Citizens Advice, and they'll prob advise you to write a polite but stern letter to the Trader first, then suggest small claims court if no joy.

They will probably give some wedge to foook offf or you can get the money back via trading stds for it not being what was sold under the sales of goods act

That option will be slower though

ask him for cash hell probably cough up

No mileage stickers BUT in original ad it says 85k miles, AND it looks like mot cert has been altered on miles bit, the first 0 looks like it was a 1

Oh, also if you want, pm me the car details ie: model, engine, spec and i'll do a CAP valuation on it tmoz at work. I'll be able to tell you what your mate should have paid for one with + 100k miles on the clock so it gives you an indication of how much money you are talking about here.

if the trader purchased it direct frfom last owner they are the only peeps that could have altered the mileage

Now if the traders altered the mileage from knowing it was a high miler thats 100% illeagal and not small claims court but trading standards who would prosecute on behalf of the guy and try to get compensation

The right thing to do is the law and TS

The easiest and probably more likely is call the guy call him a cnut and you know whats happened and ask for cash back if not see comment above

Nige, I see what you're saying, but this guy cant go in head strong accusing the Trader of tampering with the car.

For all he knows it could well have been the previous owner, he's got nothing to gain by telling them that he clocked it.

The Trader himself could've had the wool pulled over his eyes.

It does look like the MOT cert has been altered, and the previous owner put this mot on the car so its probably the trader?

Tito - that in itself is wrong. The DVLA / Post Office will no longer accept an MOT certificate that has any alterations on it (well, I say that but they have been issued instructions to reject any, but it all depends on the teller having half a brain or not).

So chances are, if your mate used that MOT to Tax the car, they wouldn't accept it.

If you contact trading standards, they may be able to relate this to other instances where people have complained about the same trader, or, if he is at fault, maybe other people who don't know their car has been clocked will be able to seek recompense like yourself.

Mate bought a Peugot 1.9 GTi with 80,000 a few years ago from a garage. Had been well clocked, it jumped up to 99999 after a few days He called previous owner who said it had done 160,000 miles Trading standards wanted nothing to do with it, but the garage offered to fit a new stereo for the trouble

The MOT shouldn't have a 0 infront of the mileage at all........ goto the place that MOT'd it last and ask them if they can show you the carbon copy of the MOT that way you will see an unaltered MOT. If as we all expect it has a 1 infront instead of the 0 pop into the trader and tell him what you know, give him the chance to cough up some dough 1st then once he's done that report him to Trading Standards

In fact get a copy/duplicate and a letter from the previous owner saying that the trader knew the mileage when he bought it, then you have proof the trader is at fault and he deliberatly missrepresented the vehicle.

Even if it had a sticker over the speedo I still think he can get done for it.

If you call him and ask him what he's prepared to do, or demand money in compensation, you could get into trouble.

Contact the trading standards people and insist they do something about him. If you take him to court you can still get your money back + cost I would think.
