If I was the bank and had customers constantly seeking refunds of charges that they had already agreed to in the Ts & Cs, I'd close the account, call in any loans immediately (they can do that) and tell you to piss off!

I don't see why an agreement between you and your bank is any different to an agreement with a mate - you promise to do something or you will pay some money. You don't do it, they ask you to pay the penalty you agreed to. End of.

No wonder the country is going to the dogs - everyone wants something for nothing - all rights and no responsibilities!!!!!!!!

Dear Mr Taylor
Thank you for getting in touch with us. I am sorry you are unhappy over your account charges.
Like any business, we do make a charge for some of our extra services. When a customer doesn't have enough in their account to cover a payment, this always means additional work. We must either make the payment for you via an overdraft or send the payment request back. Either way, it has to happen speedily. We feel it's only fair to charge for the extra work involved.
Of course it is only fair, too, that we're completely open about any charged-for services before you take them up. That's why we take care to provide every new customer with the latest guide to our charges. You can also get up-to-date details about fees and borrowing rates at all our branches, via our helpline and on our website.
Just as importantly, we do everything we can to help our customers avoid charges altogether.
I'm sure you'll know how easy it is to keep a running check on how much is in your account. You're free to get an up-to-date balance at any of our cash machines, over the phone, online and nowadays even by text to your mobile.
If you know a payment is going to take you over the limit, you're welcome to see if we can raise your limit - and we can usually give you an answer straightaway. You might know, too, that we don't usually charge fees if it's the first day in 12 months that you've gone overdrawn without agreeing it with us beforehand. And we never charge an overdraft excess fee more than three times in any one month, however many times you go over your limit.
I do hope you can see that we make our charging system as fair as possible - and why I
cannot agree to cancel your charges.
This letter is the banks final response, which means that if you remain dissatisfied you may refer your complaint to the Financial Ombudsman Service. If you decide to pursue your complaint through the Financial Ombudsman Service you must do so within 6 months from the date of this letter. I ahve enclosed their lefalet that outlines how to contact them.

Thank you once again for taking the time to raise your concern with us.
Your sincerley
Ms Musurat Siddique
Customer service Officer

So now what do i do? Originally the letter stated i would have an assitsnat manager to look at it. Now i got a joey looking at it. Not sure what step to take now in all honesty
Basically thats not the point. You know they charge, it's the fact it's fookin extortionate thats the problem.

Sod all. Haven't closed it, nada. That said I have had enough and am changing banks. I've been waiting three weeks for a cheque book. Didn't order it when I called the first time so had to reorder again (ARGH). When it still didn't come through they said they sent all cheque books by second class.

So why exactly are our charges so extortionate?!

Cola, was your claim against HSBC?

If so did they try backing out at all or was your first reply an offer of 65%?

mines against hsbc offerd me 70% i turnd it down and sent them this letter

{DATE}

Dear XXXX

Ref your recent offer

Thank you for your recent offer of £ XXXXX as a gesture of goodwill, I must inform you that I will not be accepting this offer. As outlined in my earlier correspondence I explained that the charges you have applied to my account are contrary to the Unfair Terms in Consumer Contracts Regulations 1999. Further or in the alternative, I believed that your charges are a Penalty.

Penalty charges are irrecoverable at common law. The precedent for this was Dunlop Pneumatic Tyre Co Ltd v New Garage and Motor co Ltd [1915] AC 79.along with Murray v. Leisure play [2005] EWCA Civ 963

Although in my original letter I informed you that I would start legal proceedings within 14 days, as a gesture of goodwill I will give you an extra 7 days to refund £ XXX back on to my account. If this is not done within the 7 days, I will be forced to start legal proceedings, you will receive no further warnings.

I claimed £1125 from HSBC (didnt claim interest)

Have been offered £1000, BUT as a rule I have a very good credit rating with them so maybe they want to keep me happy

I used to work for Halifax/Bank of Scotland ( dont shoot me) and I know from our reviews etc that they wouldnt close your accounts due to this

If any bank or building society looses a customer it takes them a further 7 new customers to regain the business from that original 1 customer

If you were to walk into the bank and say you wanted a charge refunded etc if you were to mention closing your account and transfering to their closest rival then they would shit a brick and roll out the red carpet for you!!!!

If you haven't got all your statements from the last six years, then the first letter that simply asks for them.

If you have got them get totting up, and send the second letter.

Fill in the Small Claims form as normal (see guidance leaflet), an claim for an "undisclosed amount". Then you can find out how much, when they HAVE to send you the statements as evidence.

god, just read all 15 pages my heads in pieces now! lol

i've just rang my bank and requested my statements for the last 6 yrs

do i need to bother with "letter 1" now then?

do i just look for "unauthorised overdraft fees" or can i claim back anything else?

i live in my overdraft, so is it possible to claim some of the interest back?
