I wondered why this post had got so big!!!
I saw the title ages ago and thought it was someone moaning about charges, so didn't bother to look!!!

I sent my preliminary letter about 16 days ago now to HSBC, no reply of any sort as yet.
Gonna give it another week, as i'm away with work from tonight for the rest of the week, and see if anything comes through before sending a second letter.
I know someone who did the same with HSBC recently, they paid up but were 5 days over the 14 days stated in his letter.
Hopefully I will get a response of some sort at least

i got a letter from hsbc today 3 weeks after following up my letter with phonecalls, they are asking me to give them a breakdown of the charges and what the charges were for, like i have a fookin clue of the breakdown when they just whack 100 quid on each month!!

dosent take long to go over your statments and copy them to a sprred sheet and work out what they owe yoy just make sure you save it so that if you get to the small claims court you get to add 8% on

ive come accross a bit of a problem
my letter was for: just under £50 relating to overdraft allowance.
ive sent the letter of asking for the money to nationwide.

As you know if we allow items to be unpaid and it means exceed your agreed overdraft of have to return an item unpaid on your account then we will make a charge in accordnace with the terms and conditions. Details of our tariffs are contained within our 'FlexAcount Interest Rates and Charges' leaflet, freely available in branches and provided when opening an account and agreed to by yourself when you sign up in acceptance of these terms when signing the application forms.

I write in response to your letter refusing my request for a refund of bank charges. I note your position is that I am not entitled to a refund because the terms and conditions of my account allow you to impose charges where I have insufficient funds in my account.

So what would the court award your bank for my minor breach of contract?
As you will be aware, the court will only award (in a non-negotiated consumer contract) a sum to reimburse actual loss. Your charges do not reflect actual loss. Rather, they include a massive profit margin or penalty. Alternatively, they subsidise the bank's global debt recovery costs and lending losses. There is parliamentary evidence for this assertion.
When the UK banks gave evidence to the House of Commons Treasury Committee on how bank charges were calculated they said:
"[bank charges] are going to pay for all the people we have who pursue debt, collect debt, speak to customers and chase payments. The way these charges are arrived at is by taking these total costs and making some assumptions about the volume that is going to come through to arrive at the individual charges" (House of Commons, 2nd report, 25 January 2005, paragraph 50).
Accordingly, your charges do not reflect the actual loss in my case. They are an illegal penalty charge designed to recover money unconnected with the conduct of my account. Please advise whether you have an appeals procedure, and if so, please treat this letter as a request for an appeal against your decision not to refund charges.
If I do not hear from you within the next 7 days, I will raise an action of payment at my local court. In that eventuality, I would require you to lodge in court financial vouching for the actual loss sustained in my case, together with your full financial accounts revealing how much income is generated from your bank charges, as against the cost of administering dishonoured transactions.

I got a result
I had to ring Capital One for a change of address, while I was on the phone I thought Id try my luck and asked for copies of all my statements.
Surprisingly enough, I was told that they would be in the post within 7 days I checked and double checked to see if they would charge me for them and was told definitly not!
So those turned up and I totalled up my charges: £475
Sent off the first letter blah blah blah, 3 weeks later (just as I was about to send the 2nd letter) I get the usual you agreed when opening the account type response, but they offered me £205.
As Im lazy and could do with the cash right now, I sent back the agreement paperwork and am now more than happy with the 205 quid I am up for the price of one stamp

I agree, but I didnt have that extra time to wait or I would of done.
What I did get came in very handy at the right time so I was happy to take it
If I was offered 200 instead of 2000 I would of definitly held out too, but it was only 200 difference.

Not one person has lost Dave. The banks won't go to court as their charges ARE illegal, and it would open the floodgates to millions of pounds of loss.

Too many posts.. I need a life!!
After reading this post I told the girlfriend about 2 months ago, we started with checking through all her bank statements, a total of 3 banks in the last 6 years. Highlighted all bank chargers over £12 and it came to around £2000.
After sending out letters 1, 2 and 3 we have received a total of £1100 back so far from 2 banks, just waiting on the natwest now so looking at a total amount back of £1500 without taking any court action, we were very tempted to take yorkshire bank to court as the charges were around £900 but decided to cash there cheque of £500 that was offered.
Good luck to anyone following up on this and whoever posted this up deserves a beer

Daz, it means that they charge you and then you call them to say you will just claim them bacvk again and they generally pay you out. Otherwise you just have to go through the process again!

Hi, if its for full settlemnet then you have done right by refusing their terms However by accepting those terms nit would not alter the fact that the law states the charges are unlawful, therefore you could still reclaim future charges.
For example if i signed a letter stating you could drive my car without insurance, does not mean you would get away with it as it is illegal.

Well, just got back from my trip away with work to find a letter from HSBC on the kitchen table.
It's taken them 26 days to reply but they have offered me a settlement of 90% of what I requested. Surprised as I had only sent the preliminary letter off, was expecting soem bullsh!t answer.
