If I was the bank and had customers constantly seeking refunds of charges that they had already agreed to in the Ts & Cs, I'd close the account, call in any loans immediately (they can do that) and tell you to piss off!
I don't see why an agreement between you and your bank is any different to an agreement with a mate - you promise to do something or you will pay some money. You don't do it, they ask you to pay the penalty you agreed to. End of.
No wonder the country is going to the dogs - everyone wants something for nothing - all rights and no responsibilities!!!!!!!!

If you go to 'moneyclaimonline' it will take you thru wot you need to do to take your bank to court...
This will cost you £120.
Ive done this, and it was issued to the bank on the 15th.

Thank you for getting in touch with us. I am sorry you are unhappy over your account charges.

And we never charge an overdraft excess fee more than three times in any one month, however many times you go over your limit.
I do hope you can see that we make our charging system as fair as possible - and why I
cannot agree to cancel your charges.
This letter is the banks final response, which means that if you remain dissatisfied you may refer your complaint to the Financial Ombudsman Service. If you decide to pursue your complaint through the Financial Ombudsman Service you must do so within 6 months from the date of this letter. I ahve enclosed their lefalet that outlines how to contact them.

Right Kids... I got ALL my money back on Saturday. One week after taking them to court. Full amount too... SO DON'T TAKE THE OFFERS OF 10%!!!!!!!!!!!!!!!

Sod all. Haven't closed it, nada. That said I have had enough and am changing banks. I've been waiting three weeks for a cheque book. Didn't order it when I called the first time so had to reorder again (ARGH). When it still didn't come through they said they sent all cheque books by second class.

Penalty charges are irrecoverable at common law. The precedent for this was Dunlop Pneumatic Tyre Co Ltd v New Garage and Motor co Ltd [1915] AC 79.along with Murray v. Leisure play [2005] EWCA Civ 963
Although in my original letter I informed you that I would start legal proceedings within 14 days, as a gesture of goodwill I will give you an extra 7 days to refund £ XXX back on to my account. If this is not done within the 7 days, I will be forced to start legal proceedings, you will receive no further warnings.

well i finally got my paperwork through from the woolwich showing all my charges and they total £12k over the last 6 years (big thanks to the now ex wife for that)
so am sending my letter off tonight for the return of my cash
could be long and drawn out but fookin hell £12k......that will buy lots of engine

I claimed £1125 from HSBC (didnt claim interest)
Have been offered £1000, BUT as a rule I have a very good credit rating with them so maybe they want to keep me happy

I used to work for Halifax/Bank of Scotland ( dont shoot me) and I know from our reviews etc that they wouldnt close your accounts due to this
If any bank or building society looses a customer it takes them a further 7 new customers to regain the business from that original 1 customer
If you were to walk into the bank and say you wanted a charge refunded etc if you were to mention closing your account and transfering to their closest rival then they would shit a brick and roll out the red carpet for you!!!!

Well i have now sent a Letter Before Action and i still haven't heard anything from Barclays....apparantly i have to send a county court claim now....anybody any ideas how i go about doing this

do i need to bother with "letter 1" now then?
do i just look for "unauthorised overdraft fees" or can i claim back anything else?

i have contacted someone at the courts who said i have to pay the £120 when making the claim, i can claim the money back but there is no gaurntee i will get it back!!

i've got back £2374 from the Halifax they offered me £591 at first and as soon as i sent a letter saying i was starting court proceedings they coughed up!! keep at it peeps you will get all your cash back like i did!
