License "totting up" points...

Default License "totting up" points...

I currently have 9 points on my license. Of which the first 3 points are now over 3 years old - so I believe this means I technically have 6 valid points?

I got flashed on the M25 last nite by an overhead camera just as you approach the variable speed limit area for the M4 (anticlock wise) doing around 85 - 87 mph. I've been passed that stretch of road loads of times and never known that camera to go off - didnt actually know there was one there!

Anyways, I expect it will have been loaded with film and I'll expect to get a nice letter in the post in the next few weeks so my question is:

Am I now liable for a ban? Or as my first 3 points are over 3 years old I'll just go back to 9 valid points?

all my points so far have been SP30s, (I think this particular offence is an SP50?)

My understanding is the same as you first mentioned, that you will be ok, you will have 12 shown, but only 9 that count for totting up

As far as I'm aware, your points last for 4 years (I looked this up on the DVLA website)

I am also on 9 points

From my understanding the points are valid for 3 years but must remain on your license for a minimum of 4 years - as they can still be taken into consideration.

I think this means if I were to go to court for a motoring offence. Such as speeding in excess of 100mph which would warrant me a ban immediately, they would also take into consideration the points on my license including the ones over 3 years old - this might effect the length of the ban or the amount of fine I would have to pay.

either way my insurance is gonna go up yet again.

I believe they stay in the license for 4, but count for totting up for 3

They are also from date of offence and not date of conviction.

Im down to 3 from 9 now.

always used to be 3yrs for totting up & removed afer 4 yrs, last time i got any points was back in 1992 in a XR3i, i went up to 9 points twice back then. I speak for myself but when i was a teenager & early twentys i drove like a lunatic, now i'm 35 i save it for the track as its not worth loosing your licence.

Pretty sure the cameras are not active.... they Flash all the time though. have been through there and got flashed 4 or 5 times and never had a letter come through.... Shouldnt worry about it to much

I've seen them flash loads of times clockwise before the m4 junction. I've sat in traffic before on the otherside and watched it go off nearly every 5 - 10 cars!

But I've NEVER seen this paricular one go off before. Its the very first variable speed underpass as you approach the M4 junction anticlockwise.
