bit of a problem, your opinions please

Default bit of a problem, your opinions please

Was out for a ride the other day with my friend and his mate dave who i only met on that day. Anyway was out and about on the bikes this dave out front on his bike then me then ian way back cause he got stuck a some lights, anyway off we go dont his country road and it comes to a nice right hander than opens up to a nice long straight, as i come round this right hander and start to go down this straight at normal pace around 60 i see a load of big rocks in the road so shut the throttle, as i did this Dave decides its a good idea to drop it 2 gears and give it large down this long straight. As you can imagine all i get next is hit in the chest with a rock hit on the helmet and visor about 3 times and the front of me bike is now looking a little worse for wear.

Now i understand that its not daves fault that there were rocks on the road BUT if he hadnt have thought he was valentino rossie and give it large through them all i wouldnt have a bill of £876 for parts alone to repair me bike, and the fact that i could see all the rocks from being behind him just proves that he obviously wasnt paying any attention at all or he is just simple as thick as mince and shouldnt be on a bike.

Damage to me bike is as follows
Nose cone has 3 big lumps out of it
front mud guard has 2 big lumps out of it
nearside side fearing has a chunk out of it on the sticker
the screen is wrecked and has about 6 chnks out of it
rad is leaking
offside indicator has a lump out of it
my visor has a chunk out of it.

Now the question is, is it just 1 of them things or is it his fault and could have been avoided if he wasnt such a fucking bellend. I'm going for the latter obviously

I'd say be polite, courteous, and go about making your point in a very calm, sensible and justified fashion. Explain to him about how you saw the rocks from a distance because you pay a lot of attention to the road etc etc (don't be patronising telling him he doesn't pay enough attention or anything like that) and simply ask him what he thinks you can do to resolve the problem mutually. Also put it to him would he be happy if it was the other way round firing stones up at his bike at x mph.

Failing that, I'd get a bit serious as I wouldn't like that done to me.

Ye well i tried the polite and sensible route yesterday took me 10 phone calls and in the end i had to phone him every 5 mins till he picked up lol, he said he has no money so go through the insurance so i thought fine problem solved. He then phones me today and says that he has phoned his insurance company and they laughted it off and said it wasnt his fault which they probably would as he no doubt didnt tell them he was balls out and it could have been avoided.

Tbh if he doesnt admit liability i'm pretty much fucked(just like he will be when i see him again) and if he had rolled through it like i did and the damage was done then ye it was 1 of those things but the fact he just powered through it all just boils me piss and makes it his fault cause it could have been avoided or at least less damage done to me bike.

Get a bunch of pebbles and dirt lined up in front of his bike and do a burnout in front of it.

well i was thinking of kicking his bike over next time i see him after i'd finished bruising him but that wont fix me bike unfortunatly. I just cant believe how stupid people are

That really sucks mate. Why don't you try claiming off his insurance though? Could your mate back you up or was he well out of sight? I doubt he'd want to get involved as well as he is mates with the pair of you.

the problem with bikes is, that for everything you could do to a car, the biker would end up dead, so you can't play the sneaky

how easy is it to put some sugar into his petrol tank them? or nick his handlebars? those guys on american chopper make it look so easy, you only need a spanner

I am trying to claim off his insurance but if he doesnt admit liability it makes it difficult, plus me mate said he would be a witness but people change there mind when it comes down to it so weather he does or not is a different matter. I guess i'll just have to wait and see what the insurance says and take it from there.

Tricky situation to be in really. Id be absolutely fuming of that happened to me and my bike!

I always prefer to be the trailing bike when out with a few and i often get hit with stones and stuff but i expect this anyway. As you say though its the fact that the donut decided to floor it through it all obviously knowing it was there! What a donkey!

Legally you wont stand a chance in my opinion. Its like getting a chipped windscreen in a car i suppose.

The trouble is its not a close mate, as a close mate would offer to pay something towards it at least.

Not much you can do really.

Ye what i thought tbh, will have to wait and see i suppose. I might just threaten him with physical violance and a damaged bike of his own and see what he says then lol

no point damaging his bike is there? that's not going to get yours fixed.

can't you claim against the council for not keeping the road in good condition? might be worth speaking to a specialist lawyer.

I think i might ust damage his nose instead tbh, i px'd the bike anyway so aint my problem anymore.
