Default MOT Question

car has mot till end of nov,

took it for a test and failed

the car cannot be used now can it?

am i right?

in the days before computerisation, if you got stopped you could just show your in date ticket, and nobody knew any different....

but now its logged on computer everyone knows its failed, and if seen on the road you could get pulled

Your current MOT is still valid up until the expiry date shown on the certificate, you paid for a 12 month mot and thats what you have, this very topic was brought up on here a while back and at that time we had a visit from VOSA at my work and i asked the dude about this and was told the certifiacte is valid up until the expiry date regardless of whether or not it has been presented for another test early and failed.

hmmmm, im not so sure, i will double check with my legal boffins at work tomorrow. i work for vosa btw

but driving a unroadworthy vehicle is an offence , nomatter when its tested and it invalidates insurance.

This guy i asked is one of them fuckers that knows everything about everrything when it comes to mot's, or so he would have you believe anyway !!! Interested to know whether he's right or wrong on this one though !!

The legal position would be;

You CAN produce a valid M.O.T cert if required,
As it would appear a fail does not cancel the existing Pass cert, at the moment.

However you cannot produce a vehicle that will pass an M.O.T .

If stopped by Plod or Vosa you would fail an inspection and would be guilty of an offence under Construction and Use.

No mot doesn't invalidate insurance, so if it's roadworthy it's roadworthy.
My insurance company don't require car to be mot'd, and neither has any other I've been with.

read the small print... every policy ive ever seen, even my trade policy states driving with known defects, or a vehicle in unroadworthy condition is not covered.

insurance companies love to not to pay up.

greenlight wouldnt cover the cossie untill it had current mot....

its the same as over tinted windows....they invalidate insurance , as it becomes unroadworthy. i dealt with a case of this not long ago

well i took the mrs car today, as i'm not chancing it.

the mot tester didn't even know the answer..

better to be safe than sorry

It's quite possible to fail and MOT and still be roadworthy, they are two different tests.
I had this very problem years ago, and was told by Jean Paul, of Norwich MOT inspectorate, when he later examined my car, as I reported it, that the existing mot cert can still be driven on perfectly legally, I thne asked is my car dangerous to the extent that the plod can do anything, he said "no, it's safe to use, but won't pass an mot".
The problem on my car is it should not have passed on many things including corrosion, so was retested locally and he called the selling garage to view the car, actually gave him an option, to come over(he said he was busy) or lose his license, turns out that is what happened anyway.
I too was intrigued by the position of legally being able to drive on a cert of a test that it should not have passed.

I think you would be in trouble with plod for that one, mine was just rust in chassis, plus a few other silly bits that soon fixed.

Done the same for my car. Asked the mot place if it was ok to drive as still had 2 weeks left on the ticket when it failed and they said yeah no probs but obviously no driving it after the 2 wks until a new mot is passed.

You can drive it. Thats the whole point of taking it in early - so you can run around legally getting it fixed before the old ticket runs out.

The only exception is if the tester states the car should not be driven on the paperwork.

Your MOT is valid until its expiry date even if in the meantime your
car fails the MOT - the original pass is still valid. In fact you can have the Test done up to a calendar month before the expiry date and have the new MOT forward-dated to the expiry date of the existing certificate. So if you have your car Tested during that month and it fails, this gives you time to have the repairs carried out and the car re-tested before the expiry of the original certificate and you are not disadvantaged as a result. - MOTT.

That would probably cover it then - you should NOT use it.

When you did that check - did you use the number from the fail sheet? If so, try the one from your old cert.

from an mot point of view its still legal to drive ! hence why you are able to get a 13 month ticket or offer the vehicle for test 30 days prior to expirery ! point being so you can repair and still use the said vehicle

From a police prerspective its illegal and your fucked end of so in heinzsight id not use till passed but there is a good chance that if you got pulled and had to go to court you could win as vosa have put you in that position by offering 13 month tickets or 30 day early tests.

Passing an MOT has NOTHING to do with ROADWORTHINESS, which is what the plod are concerned about, as Spkiy has fixed the items he can drive legally, as it is then roadworthy, and would not fail the next mot when presented.
It is still law that London Hackney Carriages must carry a bale of hay and a sack of oats, but plod won't do you for it if you don't.
Some other odd things, it is illegal to break a egg at the sharp end, doing so will land you in the village stocks for 24 hours.

I dont believe it has to pass to be honest mate,but there are so many loopholes that the law can use these days it`s unbelievable, alot of them justified, a lot of them not. You`ve got to laugh at if you get stopped with a baldy tyre,it`s happenned to me twice. First time, the copper was sound and could see that the tyre had worn on the inner edge only and allowed me to get it changed within 14 days, which i did the next day and all was well. Got pulled then a year later,same problem and no arguments, your being done. I pleaded with him to put my mint spare on, as he could see it was worn on inner edge, not interested, fined me on the spot. Now i was given no document to say that i had to change the tyre, whereas had he given me a 14 day slip like the other guy, it would have to have been done, or i would be in court etc. If you do it though, book it in and make sure that there are no baldys etc. on it, exhaust hanging off and so on, as your then clearly driving a non roadworthy vehicle.

Your allowed to drive to the MOT Test station for the test and back home again if it passes or fails. How else are you meant to get back? And i dont exactly see millions of low loaders anywhere I also believe your allowed to drive the car to a garage to have the repair work carried out and then back to the test station again.
