Default If someone else has the log book to your car.....

.... what can they do??

Had an e-mail from the guy I got the XR2 off of a couple of week back, saying he had the log book and when can we arrange a meet up to do the transfer. (He only had the car himself a week before deciding he couldn't keep it, probably as it needed TLC and he has four after cars anyway...) I know the car isn't stolen as I personally knew the owner before him anyway and I know that was all done legit.

Anyway I sent him an e-mail saying when ever, you only live up the road so we can sort something no worries, when is good for you?

No reply.

Sent him another one a few days later, re-asking the question....

No reply.

Week later I'm starting to ring him, no answer or reply, but knowing him, thats what he is like any way.

Now today I ring him and got though. As soon as I finished the sentence, "when shall we sort out the log book" phone dies

Try calling again, straigh to voicemail. Must be a problem with his phone. So have my dinner and call him after.

Rings, then though to voice mail

Try again, phones off.

So WTF is this guy playing at?? Does he not want to sort out when we can do this log book thing. I mean what possible good can the log book do him... if he aint got the car, and ESPECIALLY, if the car is registered in his own name???????

So I'm trying to work out WTF this guy is up to....

Gonna write out a letter to the DVLA now requesting the log book, but I'm kinda worried.... whats his game....

If that is just the records of oil changes and maintenance, then not much at all I would say. just sucks to loose it.

if you have the green slip(new keeper supplement) then it doesnt cost a penny, just staple green slip to V5 application form.

if hes give you all that then theres probably a reasonable explanation-the kids have drawn/scribbled on it, the missus has thrown it in the bin etc.
seems honest enough if hes give you all other docs and there probably is a proper explanation.

If you have the newest log book in your name then it doesn't matter what he has

Dont have the new owners slip as he was waiting for the log book to come though for him when he got the car

Just downloaded a V5 filling that out now.

IF anyone needs proof of when I got the car and who from there is a whole thread on it on the FS forum.

But to hang up on me (maybe) then not answer his phone, it does have me slightly worried...

As long as he has the new book and gives it to you, no problem. Otherwise can of worms

i cant see as he can do much, not much point reporting it stolen or lost etc. due to you having all the paperwork which he gave you (barring V5)
i think theres a reasonable explanation

The V5 is the ownership. Without that and even if you have, in some circumstances means you are not the owner. Long story, but mate was had out of a car by that very means

i know what your saying mate but doesn't it say on the V5 or somewhere that possesing the V5 doesn't mean ownership of the vehicle?

Well its not like I can't prove I dont own the vehicle, the owner before is witness to the fact I bought the car and identify it if need be. Not only that the whole transaction was confirmed on a public internet forum ( http://forum.fordsport.org.uk/viewth...id=5038&page=1 )

So its not like I can't confirm it can I

Depends on who has the stronger case, hopefully in this case it's madmac if that's what it comes to

you only have to pay the 19 quid when applying for v5 if you lost old one, NOT if you are the new owner etc..

Plus a V5 IS NOT proof of ownership anyway it is simply the registered keeper

Quite right - the registered keeper is not necessarily the owner.

Stu - why did you buy a car without the logbook, or the change of keeper form?

Isnt it the case that if you apply for a logbook that way, the dvla contact the registered keeper and if they dont reply then and only then will they issue a logbook to 'madmac', surely if the guy replys then he could continue to be the registered keeper. its unlikely that anyone would do that though. Surely theres some sort of misunderstanding, maybe hes just sick of being hassled and a bit lazy?

you'll probably find that theres a simple explination for it all but i cant really see him being able to do much really except kick up and fuss couse a bit of hassle and get nothing in return.

if he did try and get the car back i cant really see it holding up as u've had the car for months now and its not like its been reported stolen so thats the first thing the police will ask, why's it taken so long for him to report it.

and lets face it its not exactly like the cars brand new and is worth ŁŁŁŁ so its not exactly the sort of car that u would risk stealing and try keeping as ur own.
