Default Recieved a court summons aswell

I had a court summons through for being caught by a gasto.

The court hearing is exactly a year after the date of the offence. It will bring my points total up to 9 so id like to get out of it if possible.

Is there anything i can do i thought theyd have to get it sorted within 6 months of the offence or itd be invalid??

you woz selling the car at the time and cant remeber who it woz who woz driving as you had loads of people test drive it down that road that day.

I thought they had to summons you to court within 6 months of the offence and give you a NIP either at the scene or within 14 days?

I presume you received a notification of intended prosecution? I "believe" that they then have to prosecute within 12 months (providing you're not involved in an accident)? Best check that out for sure though.

However, the good thing is that if you ARE prosecuted, then it is from date of offence NOT conviction, so they'll be on your licence for less than 2 years. However, given the time gone by, I would most certainly speak to a SPECIALIST motoring solicitor to find out the score.

so i can only get out of it by blaming it on someone else or making it impossible for them to find out who was driving . Will have to have a think about what to do

Yes i did get the notification but chose to ignore it.

Then the fact you chose to ignore it is your fault . Take the points like a man . The only thing you can do is keep ignoring it for another two years, and then when it does get put on your licence, the points will be spent .

Seriously though, I don't know what would happen if you DID do that .

if ya got a sumons say its not viable to attend on that day and ask for it to be changed, then get 4 mates to admit they was all driving the car on that date and see who they convict

fook it, your guilty so get the points

im inocent and up for dangerous driving, the guy whos mates take the piss cause i drive too fooking slow

i know thats the ironic thing, ive never been faster than 135 in me cossie and i usually drive at 90 on the motorway



also dangerous driving for a person whos never had a crash or run over a small child

have they never seen a bus in there life or somink

im sure i read on the pepipoo site (?sp) that it had to be within 6 months

If you cant provide evidence as to who was driving then the registered owner gets the fine/points.

Doesnt matter if 5 people were taking it in turns etc and if you were selling the car and giving test drives, if you dont prove who was driving then you will get the fine/points

The loophole was changed some time ago

Plenty of people on that site have time expired there nips from gatsos by ignoring the mail and then engaging the scamra team in correspondence!!!

Yon need to check out the forums in the site loads of people get away with it

Thats not true, you have to provide the names of the people that could have been driving at the time, it is up to them to PROVE who was. However, you cannot say you just don't know.

We have had three people avoid points from cameras this way within the company so far (these were company vehicles though). We provided them with a list of people that "could" have been driving the cars (company pool cars) and although it is advisory, it is not compulsory to keep a log of who drives what when.

My bad, as you said you cant just say you dont know.

But be aware you may need to provide proof they were insured to drive the car if they are traced or in the case of selling the car you could be in trouble for letting an uninsured driver looses in the car.

Doubtful it will get that far but ya never know.

well alot of people are insured to drive anyones car on there insurance meaning they are part of that group

As usual, you are totally and utterly WRONG . However, if you get BANNED then it is from the date of conviction, so that's YOUR luck shat out .

The thing is, I posted this the LAST time you said that as well . How thick are you? .

Taken from the DVLA website .

Period of time
Periods of time are signified as follows: D=Days, M=Months, Y=Years

Endorsements remain on a counterpart licence for:

11 years from date of conviction for offences relating to drink/drugs and driving, causing death by careless driving whilst under the influence of drink/drugs and causing death by careless driving then failing to provide a specimen for analysis

4 years from date of conviction for reckless/dangerous driving and offences resulting in disqualification

4 years from the date of offence in all other cases

mike is write and with his personal experience i belive him,,,,,,,,,, oh and DVLA confirmed it for me too when i was crying on the phone about getting 9 points, was crys of laughter though as i longed the court date for 8 months and then got told its from date of offence
