wife bumped the car this morning

Default wife bumped the car this morning

we live on a pretty narrow road and there are always cars parked on our side of the road at either side of the drive etc.
this morning the wife was driving out the drive an rolled out onto the road inbetween the parked cars,looked left then right as she was moving out,again no faster than 2mph or so when a pug 308 came from the left and they both collided. now the wife reckons she did struggle to see the road because of the parked cars but also that the pug was nowhere one second and there the next,she says the pug was going harder than it should have been,people do tend to speed up and down the street quite a bit.
theres quite a bit of damage to our A3,headlights out it,bumpers ripped off and wings f*cked. the pug on the other hand has a dent on the os wing and door,it definately won the fight which surprised me lol (A3 is also only 6 weeks old ouch) main thing is no one is hurt and there was no falling out

my question is though,whos at fault?! or is it just simply a 50/50 accident?

(it doesnt make a huge difference to me personally as the A3 is a company car so wont affect our insurance etc but just interested in other views)

equal responsibility IMO, pug has ultimate right of way but he shouldent of been going faster than conditions permited (being mindfull of the parked cars) , what if it was a kid and not an audi A3???

I'd say hers.. Youd have to prove pug was speeding.. And she's pulled out..

very good point!!! i tend to think at the moment its a 50/50 thing,you're right though what if it was a kid!

well thats the point she cant prove the pug was speeding,im happy to tell the fleet company what happened and let them sort it,the woman driving the pug commented that she also had an accident last week,if its true these things happen in 3's then she better stay in the house for a bit lol

Technically it was your wifes obligation to give way as she was joining the carriageway. Always difficult when cars park so close you can barely see and everytime you do it you take a risk you dont necessarily even perceive.

IF the other car was speeding and this can be proven (skid marks etc) then it will probably go 50:50, otherwise fair or not it will be her fault.

Unfortunately your missus is at fault. She was coming onto the road, the other vehicle speeding is totally irrelevent as far as insurance goes

yep as said, you have to give way to traffic on the main road. I seriously doubt unless she was doing 60 or something, there would be adequate evidence to lay blame on the pug.

Damage doesnt sound like she was doing more than 30 either.

I had something similar happen about 5 years ago and the best settlement I could get was 75/25 in their favour as I was exiting a minor road and they technically had right of way.

I would say it's your wifes fault, even if she was speeding, it's still your responsibilty to make sure the road is clear before you pull out onto it!

However I know you SHOULD obviously use your loaf and adjust the speed to the road conditions, but the fact is the majority don't, if it's like you describe the Pug shouldn't be doing anywhere near 30 MPH, as thats the MAXIUMUM speed permitted and you should allow for the road conditions, the sad fact is most seem to lack common sense!

This gets me going when people say the car was speeding ok maybe not in this case due to parked cars limited vision but the car was going to fast is a common excuse my answer would be ok but why pull out infront of it then? It's like pedestrians won't walk out infront of cars but will infront of a bus were the chances are if it hits them they would be injured far worse lol

not making excuses turbochild but for this particular road and parked cars etc 30mph is certainly excessive,as martysmartie says 30 is the limit not the aim.i'm normally 20mph max on these roads,hear what you're saying though its an easy finger to point.

100% your wifes fault, you have even said she KNEW it was difficult to get out, so she should of proceeded with the most amount of caution possible.

Good side is like you say, not your insurance so who really cares, not costing you anything.
