Default Redundancy help !!

Just looking for abit of advise from anyone in the know , Basically and ill try an keep this breif the company ive worked for for 11 years is rapidly going down the pan , Now my options are to move with the company as they are looking to fold the company including all its depts an start a fresh company doing the same thing but it would be working for alot less $ than i am currently on which wasnt alot in the 1st place... Or Leave / quit as my original job has been made redundant... I myself just want to take the redundancy money and leave which my boss says is not an option ?? He says i either quit or move over to the new company... By law does he not have to pay me redundancy if he is closing the original company that i work for ?

Any help would be greatfull as im suppose to be giving him an answer what i want to do...

If he is closing the original company wouldn't that mean your being made redundant so he would have to pay you redundancy. Best speak to C.A.B though.

Correct.

Closing a company just to clear debts and setting up a new one is dodgy anyway.

As said, get some legal advice - 1st hour is usually free at a solicitors or speak to your uninon (you are in a union aren't you?). CAB are really busy atm so you might struggle to speak to someone their.

No unfortunately we dont have a union ,, Going to try an get hold of a solicitor today an see if i can make an opointment .....

Thanks for that , tryed to get in touch with them yesterday afternoon , i was greated with a msg saying there was an approx wait to speak to someone of 20mins ... Will try again in a bit though

Your employment will be terminated when the original company folds.

If you stay on I believe you will loose your right to your redundancy.

If i move to the new company i loose all my redundancy entitlement an any benifits of being a loyal employee for the last 11 years....

It seems wrong to me that i will loose the right to redundancy if my company folds...

Just got off the phone to a local solicitor who has made me an appointment for tomorrow Ł 200 per hour plus vat i was expecting it to be like half that

just got hold of acas (5 min wait so not to bad) They have basically said that as far as they are aware my compancy have to transfer my service record over to the new company.. But with regards to getting a redundancy pay out that i would need to seek the correct legal advise ...

Legal advice is free for the first hour...... I would join a union then use there solicitor and advice.

I think its industrial tribunal not court bud...

I may be wrong but i believe the government gives you some redundancy and the employer matches it. Get him to put his offer in writing to cover your own arse. john.n
