Advice required - where do i stand legally

Ive recently changed jobs, and my old employer keeps payin me. I only realised when i opened my statement this morning. Where do I stand, do I have to pay them back?

Not holiday pay, its exactly the same every month, i was on a salary so I was paid the same every month, and its the same amount. Any idea were I stand legally? thanks

to be honest, not really close enought to my statements etc. I know my income is far greater than my outgoings, so never really open statements/bank balance etc etc. When i open the one that arrived this morning, i checked back and its been goin on for last 3 months. Whats the best thing to do? keep my mouth closed, or tell them? Any idea on the legality of it?

u dont need to pay them back a thing when a left arnold clark they over payed me 2 weeks wages and sent me a letter saying they did so (chancing there luck) and telling me to get in touch to set up a way of paying them back but i just ignored it and they could,nt do a thing
if they overpay u its there fault . its like checking your change when u leave the shop if u dont do it at the counter u have,nt got a leg to stand on . hope this helps

legally you will have to give it back
but keep your mouth shut and hope they stop and you don't have to![Grin](https://passionford.com/forum/images/smilies/icon_smile.gif)
or cough up and say "exciuse me, here is your money, please stop paying it into my account oterhwise i will treat it as my own and spend it"
enclose a cheque for the amount they've paid and if it carries on at least you've warned them

I had it 3 years ago, the company payed me after i left and they kept sending letters asking me to return the money in a cheque which i never did it was there mistake.
Then about 16 months later i got a thick envelope with their name on the front and i thought it was some sort of court summons. When i opened it i found it was an employment contract and the cover letter said something along the lines of " We are pleased to inform you that you have been successful and would like to offer you the position of *********** could you please fill in you sizes for the uniform and sign, return you contract of employment, What!!!!!! i rang them up (didn't want to get stung on tax or something) and said i haven't worked for you in 15 months but nothing was mentioned about the money and they blamed it all on inexperienced office staff.

legally you have to give it back; but i work for a large organisation and it really does depend on the company if they persue you for the monies they've paid you
i would pay what they are paying you into a seperate a/c and dont spend it.......if then one day they start threatning u with legal stuff at least you can give it back

you have to give it back i got hounded by a well known computer company for 2 years when they paid me for a few extra months after i left. there is a good info on the acas web site about it.
