a little bit pissed of tonight , one of my my members of staff phoned in today, been up ll night with the shits and sickness,so weve been charging about all day becouse where busy , anyway just been to maccys on way home and hes sat in the car park in his car with his mates , windows down chatting, hardly sick in my book

where do i stand?
whats the law on sickness and being out and about

theres nothing you can do is there unless hes been caught working somewhere else iirc

everyone pulls sickies at some time or other though

I've had pretty much the same thing happen to me mate. Basically you can't do anything, they can just say they were feeling better so that's why they were out.

Well really, theres nothing you can do other than to pull him into the office and "counsell" him and get it documented, and get him to sign the form.

That should then remain on his personnel file for future one off days alleged bouts of sickness.

he may well still have the shits though, just because you saw him out in a car doesnt neccessarily mean he isnt ill,

just make it clear that you saw him if he tries ringing in sick

or do what my boss said to me ( which she wasnt actually allowed to) " if you dont come in disciplinary action will be taken for anyone phoning in sick of xmas period"

as it happened i rang in sick as was in a car accident

Just ask him how he felt, see if he felt better in the evening, sound concerned.

If he says he had the shits all day and night, fucking tell him!

if he's been with you for less than 2 years, I think, you can sack him without reason.

I don't pay my staff for sick days, and they better bloody answer thier home phone if they say they are off.

bloody skivers, make my blood boil....

Welll, in that case, id say that you had seen him in Mcdonalds. However thats then 1 on 1 . Personally id have said hello at the mcdonalds, and said something like " hello ... glad you seem ok now, we missed ya today as it was busy. See you tomorrow" then walked off.

He cant reply in time, and cant really in my eyes then phone in.

Are you a Manager or a Line leader?

if hes in tomorrow just ask him how his maccers was, let him know in that way that you seen him. everyone has sickdays tho but he could just come out with he felt better.

I think its better you letting him know thats he was seen rather than blowing your top.

sick pay is at the decretion of the company in most cases so you don't have to pay him

one of the guys who was sacked at our place recently was told that he was having too many days off sick so he wouldn't be getting paid for them, he had 55 last year and 48 the year before and the ocmpany only pays for 8 weeks sick IF you're off for 8 weeks on the trot (i was off for 5 or 6 but it was all documented that i was sat at home with pipes sticking out) but this guy would phone up on a monday and say he was sick and then come in for a few days and then call in sick again

i'd cut him some slack, mentin it to someone that you've seen him in maccy d's and let the word get out

obviously, if he doens't come in tomorrow then give him a call and find out whats wrong with him
