Been following this thread on and off for a while but never had the balls to claim until I got a statement yesterday and was charger £30 for going £9 over my o/d limit for about 12 hours. So just printed request letter and gonna send it tonight. Has anyone been offered a settlement straight away without the bank sending out any of the previous statements? and if so is it anyway near the actual amount owed?
I reckon they could owe me thousands over the past 6 years but its gonna be a long hard slog going through old statements but I suppose it will be worth it in the end.

people do get offers come with their statements but its usually a pathetic one make sure you send the one from concumercorner as it is a lot more detailed and also acts as your first request for a refund. which cuts the whole proccess down

One more question as I have sent 1st letter. On my bank statement it says £40 fee for having the overdraft then another £30 charge for going over. When I total things up do I include both these charges or just the charge for going over me overdraft??

hi, if the overdraft is either lequal to or less than the amount of charges then yes claim the £40. also if the overdraft was given to you to pay the charges that were accumulating then its the same answer.

1 more thing; if the above applies then you claim the overdraft interest as well

Sorry shaun but thats a bit double dutch to me. does that mean I can claim the fee for having an o/d aswell as the penalty charges for going over it?? Sorry to be a pain, but I need things in terms of a 3 year old

hi yes you can claim the fee if for instance your overdraft is for £500 andthe charges are £600.

in which case you would have had no need for an overdraft as you would have been in credit by £100 if they had not applied the charges nor would you be paying any overdraft interest

sorry hope that makes sense but this is one of the more complicated issues when claiming the fees and interst back as well as the charges

I've finally sent my letter off this morning to Natwest, requesting my statements etc.

How long have Natwest normally taken to respond for people on here that have dealt with them? And also, are they one of the banks that closes the account of the claimant?

Natwest usually take a month to get the statements out and they take it right upto the AQ stage, but they dont close accounts

Allocation Questionaire (just a yes/no form from the courts) which comes when they put in their defence about two weeks later they offer you a 50% settlement which you reject then they offer you 100%

long winded but very predictable RBS are now doing exactly the same

Ah I see. So without having to read through the whole thread, will I have to actually initiate a claim through the small claims court then? What will happen with them after I send a second letter requesting that the charges be paid back?

when you send the 2nd letter called the LBA they will either ignore you totally or make you a very small offer. it depends a lot on how much you are claiming.

having said all that we have just changed the LBA and a natwest claim was paid before the court stage, but its to early to say whether it was the re-worded letter that did it or just a one off mistake by natwest

I got two letters from Halifax last week telling me they couldn't send me my statements. The first letter had a £60 cheque in it, and the second had a £53 cheque in it 'to thank me for my custom'

After them, I received all my statements and the charges added up to £111. I take it, its ok for to cash the two cheques.

I think they have made a mistake and only meant to send one, but is there anything they can do if I cash them both?

they cant do anything as they add up to tha amount of charges. get them cashed.

Here is a brief step by step guide to claiming back your charges


PLEASE NOTE all letters should be sent recorded delivery with the possible exception of your statements request
please click on the blue highlited links for documents and related information

1. If you do not know the amount the bank has taken from you and you do not have your statements then send the http://consumercorner.co.uk/forum/index.php?topic=16.0

there is a maximum £10 fee for this, which they have 40 days to comply with.
it is best to hand in the letter with cash at your branch and gain a reciept, as the 40 day clock will not start until they have the cash or have cashed a cheque, however if this is not possible then sending a cheque or postal order is fine.
it is also advisable to chase the statements or list of charges up with a few phone calls as they will try and stall the whole proccess, and may even send a letter reffering to statements not being available on microfiche, where in actual fact this is covered in the letter, and is just one example of stalling, and will be dealt with if it happens

2. Now that you know how much you are claiming you will need to send the LBA http://consumercorner.co.uk/forum/index.php?topic=17.0

(Letter Before Action) and the Shedule A doc http://consumercorner.co.uk/forum/index.php?topic=18.0

showing the list of charges giving them 14 days to repay your money. You may or may not get a response from this.
however it is usually a partial settlement, or a letter saying that they are looking into it, and will be in touch shortly, or a simple no we are not paying up.
if it is the partail settlement then there is a letter to send refusing this if you so wish (which we advice you do)

3. presuming you have not had a full refund then on the 15th day of sending the LBA, you should file your claim with the courts. this is where you get to add the 8% interest http://consumercorner.co.uk/forum/index.php?topic=60.0

This can be done in one of two ways, either online at Moneyclaim online https://www.moneyclaim.gov.uk/csmco2/index.jsp

you will also get the same scenario as in point 2. a) partial refund, b)full and final settlement, c) ignore you, or d) follow the court procedure and file the acknowledgement of service then defence.
if it is a) send them the letter refusing. b) or c) you win, go and relax d) just sit tight a little longer until they do pay up. remember they are not going to enter a courtroom with you.

it is just a waiting game
