Just a note to say Lloyds just paid out my parents claim in full. They took it all the way, and in the end the judge threw it out for abuse of process
You really have to stick to the timescale, and don't belive them when they say they are 'dealing' with it. They are just paying you lip service.
Stick with it and follow every step correctly and youll soon have your money.
It's also worth noting that the case that Lloyds won was the fault of the person claiming. They had left sections of the questionaire blank

I received £580 back the other day, no court action, just a letter stating how much I wanted, think I got back about £30 less than the full amount but not going to muck about over £30... Job done (First Direct)

I've sent back the wifes AQ last week so were awaiting a court date, I have to have my AQ completed and returned by the 16th July and then await a court date ! Awkward buggers stringing the process out !

quick update recived a offer today from natwest of £780 paid into my account no questions BUT my total chargers added up to £1783 so what do i do take that of stick it out and go for the lot and how do you turn down there offer

Just making doubly sure. Is you next stage to raise a claim against the Bank via the MCOL website ? Was the last letter sent your Letter Before Action which states that your next stage is to file a claim against them ?

I have not received a satisfactory response to my earlier request for charges which I believe were unlawfully applied to my account.
Under the Unfair Terms in Consumer Contracts Regulations 1999, charges must reflect administration costs and cannot be punitive.
The £1731.33p charges are unlawful as they do not reflect the true cost of going into an unauthorised overdraft. As a result, I intend to claim the full amount plus interest and court fees through the county court.
I look forward to a full response to this letter within seven working days, otherwise I will commence court proceedings.

Had 2 letters back from Lloyds TSB saying that they were refusing to repay the charges and that they were reasonable for the services they had provided, sent them the next letter then saying that i was going to take them to court and got a reply from them yesterday saying that they are going to refund me the full amount of £608. Result
Has prob taken around 2 months in total to sort it out but worth it in the end, wasn't that hopeful of getting mine back after that guy took TSB to court and lost !!!

i`v sent the letter saying that i wanted the full amonut back just over a week ago still not heard anythink back should i send them an other letter or just wait abit longer?cheers paul

Well - a while ago I reported on here my success in getting a settlement from HSBC and assurance they would not slap any more big charges on my account.
2 month later - my account has slipped over the overdraft limit for 2 days (due to delay in tranferring funds) - HSBC thank me for this by slapping another £50 of charges on...
I sent them a mail thru online banking asking WTF they are playing at and quoting the usual "disproportionate fees" lines - and they come back with the same old bollocks that its in their terms and conditions so theres nothing I can do about it...
oh well - I feel another threatening letter coming on....

Took them about 3 weeks to write back to me after i sent them the letter saying it was going to court, letter just said that the charges would be refunded to my account within the next 10 days.
Few paragraphs saying that the charges were all part and parcel with going overdrawn etc etc and that they never ususally agree to refund them but on this occasion they would make an exception !! Yeah right !!!

In a statement, the British Bankers’ Association (BBA) said: “The FSA has agreed to issue a waiver, with immediate effect, to suspend the handling of customer complaints on bank charges pending a decision by the court. Other banks who are not party to the court action will be applying to the FSA for a waiver and as such will be bound by the outcome of the court case.”

After reading and hearing about the latest plan to with hold any payments by the banks i was sure i would have to wait for the £608 they said they were going to repay me but i have just checked my balance online and the money was paid in today, Result
