Keep to the instructions you are following. (Im guessing your following the Consumer Action Group as many others are) I assume its telling you to only give them 2 weeks. The banksare staling you to see if your serious, If you give them the 4 weeks they will eventually say that your matter is declined etc etc. Just send the LBA (letter before action) after the2 week deadline

I've was offered £2935 a week ago and have since declined it. I have already raised the Court claim 2 days before the offer came in so I want the lot !
The only advice I can give is read as much as you can on the Consumer Action Group web site and ask as many questions as you can. They are an incredibly helpful bunch !

Not quite sure where you are. You said they have declined to refund you but the letter your going to send seems to be of the same request ?
You should be following this :

Letter 2 - After going through your statements you then write a Prelimanary Letter. This requests the refund of £xxxx and a copy of the charges ( I know CAG supply a spreadsheet which works out all the interest aswell and is very helpful). They have 14 days to respond to this letter.
Letter 3 - They will no doubt have ignored letter 2 or sent you a standard reply along the lines of we will get back to you in 4 weeks. Ignore and send out the LBA (Letter Before Action) This letter will state that they have a further 14 days to refund said charges or your next action will be to file a claim against them.

If you have sent them a breakdown of your charges and the Prelim letter then and they have sent you the usual fob off letter then you DO need to send the LBA. Stick to the guide though and make sure you have given the bank 14 days before you send the LBA.

I cant remember who i sent the first letter to - it was some ombudsman i think. THe second letter went to the branch manager at my local branch.

M - Try ringing the bank. If you state that you are willing to file a claim if you need to then im sure they refund you. However if you go down the route everyone else is then as it is a small ammount then they will refund you before you need to raise a claim. IMO anything under £500 they are refunding as a good will gesture

Was taking Barclays to court, but they sent me a letter saying will you exceot an offer of £925, they owed me £1100, so I chose to accept the offer rather than go through with the court action, only because it would have cost me further in court fees and so on, yes you get it back but just though I would be better off with the money now, so I was £925 better off till I sent the lot clearing up some debts I had!

All - thought I'd share my success story and some tips...
I'm with HSBC (14 years with them)...
If you use internet banking then I'm guessing the like HSBC you will be able to access your last 6 years statements online - meaning you don't need to send letter and £10 and wait for paper copies of statements...
SETUP A CURRENT ACCOUNT WITH ANOTHER BANK FIRST!!!! That way if they do decide to close your account you are already setup somewhere else...
I used the template letters and the calculator from www.moneysavingexpert.com for all my correspondance....
1st find all charges (DD charges / overdraft payments etc) and enter them all into the calculator. This will give you a printable sheet of all the charges and the total including the 8% interest. Complete the letter asking for charges plus interest back and send this to your bank (branch / HQ whatever - it will get to the right place eventually) recorded delivery. You will have 4 possible outcomes;
1) they pay up immediately
2) they say they will get back to you at a later date
3) they dispute your claim
4) they ignore you completely
If its anything other than the first one - give them a couple of weeks and then send the letter allowing 14 days for a decision or you will start legal action (small claim)..
In my case they replied within a week offering to pay the full amount of charges but not the interest.... I have accepted this...
