i just sent my first letter off with a £10 postall order to nationwide.

40 days and counting now - lets see what they say.

I don't know if anyone can help but i have tried the letters on behalf of my girlfriend and we are still not having luck with it. It's got really stupid.

Nationwide keep saying they haven't broken any law...

Can I e-mail anyone the details or offer any further advice?

Hi they will keep saying that you need to start court action against them by the sounds of it, which gets you a nice 8% extra. you can email them to me admin@consumercorner.co.uk

So I am going to have to take natwest to court !! So far all i have done is ring them and ask for 6 yrs statements! which they happily did for £5

Just to give you all a bit of hope.....

I started the process against my Bank in July (Lloyds TSB) claiming £1,700. I sent all the necessary letters and followed the timescales between sending each letter. I checked my bank account the other day and low and behold they have just settled my claim with the full amount. I haven't even received confirmation from the banks solicitors to say that they were willing to settle the claim!!

What a nice early crimbo present all for the price of a few stamps and a little bit of time and effort.

Received our Notice of Issue from the courts today for our claim against Barclays. They have until the 12th of December to reply....... tick tock.

Keep at them everyone. Just a quick update though i have spoken to the ICO and they have stated that cheques do not have to be cashed for the 40 days to start

yes you will more than likely have to take them to court but dont let this put you off natwest are very predictable

13 days to go for HSBC on my initial request for re-imbursment, any idea how arsey HSBC get? do they drag it all the way generally? fuckers..... hope they do, an extra 8% would be very handy

i forgot to write what happend to me about this...
firstly it cost me £90 for 3 & half years statements,
totalled it up to about £1600 worth of charges,
sent the letter telling them to pay up,
a week later i got a letter 3 pages long telling me about contracts etc etc
basicly they have told me to fuck off?
what now

that was clydesdale bank by the way

How are the Royal Bank of Scotland at paying out? How do you go about filing a court case in scotland? On consumercorner, the link to court forms only mentions england.

Barclays had my statments to me in 3 days, cost me £6 per account, cant fault them there..

Well I got me statements through for the last 6 years from Halifax!!!! 116 pages of the fookers!! Went through them all and only had a bad period of 3 months where i was overdrawn from my overdraft by the odd £100 here and there - in the 3 months of that I had totalled up over £700 of charges - in 3 fookin months!!!!!!!

So do I just send the first letter of adjusting the necessary bits?

I guess these charges are for going over your overdraft limit and getting a "penalty charge" as such right?

Then it's probably not worth me bothering to go back over the past 6yrs of statements as I only ever did it half a dozen times, and think I was only charged £20 a pop. Ok, ok, so thats £120, but that ain't worth the hassle! If it was £700 like Chris, or £1600 like smitsturbo then year I'd do it, but is it worth it for £120?

£120 for sending a couple of letters, not a bad job if you can get it

My mum has heard that if you have incurred alot of the same charges like constantly going over you over draft etc that the courts are starting to rule against you and take the banks side is that right???

thats total rubbish you are right the law is the law and the only consequence is the bank has continually broken that law, you have repeatedly recieved charges because they have money that belongs to you.

as for courts that have ruled against such behaviour this is also rubbish as there has been no rulings whatsoever, none, zilch.

we would love to get the banks in court and have a ruling, but they have this nasty habit of paying up all the time before we get there

Sorting out taking to Natwest to court now and just sent my 1st letters to Nationwide for £900 now.
hope i dont have to take these to court aswell £80 a time is alot lol

Sent my 1st letter away exactly two weeks ago today (17th Nov) and not heard nothing from Lloyds TSB so far, so I thought I would ring them and ask where my statements were??
When I rang the call centre I had explained I was waiting for statements. The lady on the other end must of knew straight away cos she said 'are the statements for your claim against the bank?'. Just thought it was strange how the call centre would know when i wrote to my local branch.
However, she said it usually takes 28 days. Does this seem the norm for Lloyds TSB??

there is no second letter, there is the statement request then the LBA then court.

shaun,a while ago i got into a lot of trouble with one credit card with the mbna and was getting charges monthly for ages.im back in credit with them now but hate paying this due to the way they treated me.

its going back about 4 years.

the bastards offered me a loan to pay off al my debts on the understanding they dropped my credit card limit from £3500 to £500,about a fortnight later they upped it to £4200 instead!and you can imagine what happened!!!

what are the mbna like to claim off?

Hi, MBNA are not the the nor the worst if i remember rightly they are part of HSBC (might be wrong ) Hsbc are good payers but regardles of any of that they pay just the same the only difference is how long you have to wait. so the sooner you start the sooner you get paid back what is yours

This has been a missively interesting topic to read, we will be doing the same in a month or so when we are properly sorted, but for the last year ( I was at uni but we have a mortgage so paying it off on one income.. oh and we got married! ) we have only been going over our limit because of the banks' charges!

Hi, why not send off for your statements now, they can take upto 40 days to arrive then when you are ready at least you can go straight for the claim
