my mrs was pulling out of our street (T junction turning left) her path was clear and some stupid twat of a woman thats was coming the other way going way too fast cut into her path to avoid a parked her on her side, she didnt hardly brake, both cars smashed up, insurance blamed my mrs as she was pulling out of a junction, the insurance said because my mrs was 'pulling out' she didnt have right of way not the fact that the other woman swerved onto my mrs's side to avoid a parked car on her side!

why dont you just get a copy of the footage off the solicitor. should be digital these days. You could even upload to youtube and stick it on here.

Without seeing the video, your descriptions are vague at best and make it sound like you pulled out on someone

from what i can gather,..you were in the car park moving from one space to another, the taxi turns from the service road around a lorry into the car park and hits your 3/4 as your moving. If thats the case i agree its the taxi drivers fault, why would he ring his mates to be witnesses if he wasnt in the wrong?
Im taking it you were in a carpark moving spaces not pulling out into a road as such?

Given his diagram i suppose it depends entirely on where the taxi was as he moved out of the space.Bearing in mind that im assuming, as he moved out the space the taxi was pulling into the carpark

For what it's worth i hope you win as Mr Taxi is obviously being a cunt trying to get other taxis to be fake witnesses.
In my local Sainsburys carpark there are taxis that sit in the spaces waiting to be dispatched to jobs and they are total pains in the arse. When you are trying to leave a space (with caution) they don't hang back and let you go they just plough on regardless with no consideration for other drivers - total wankers.

Update thanks for all who been on my side had an accident specialist (private eye type accessor) round today as its going to court because I argued it (he just happens to be an ex police accident investigator) and the 3rd party is at blame and there is now proof he has lied and fabricated evidence!

1 point I never thought of or made before which (insurance acessor) brought up is look where his car is (on the wrong side of the road way) which he said regardless of being in a car park etc he is automatically at fault.

Lol basically he had 2 independant witness's in his car (taxi drivers car) but hasn't used them as witness's instead he has fabricated 2 witness's who have made statements against me but what taxi driver didnt realise is;
1. I took photo's of the scene (showing all involved and the car park)
2. His and his fake witness statements contradict each others.
3. Photo's show him being on wrong side of road which he refutes.
4. Where his witness's say they were parked the lorry parked directly between them and the accident.
5. The witness's say they were reversing there car into a space at the time of the collision (Accessor says if they was reversing how did they see the accident as she would of been looking where she they was reversing)
6. The witness's say the lorry position is different and accident happened in a different location of car park which my photo's show they are taliking shit.
7. I have 2 independant witness's and what they say is similar to what I have said.
8. Biggest mistake he (taxi driver) made of all was, his witness's say they did not come over to the scene as I was very aggressive so they waited till I left and approached taxi driver with there details. However police were at the scene and I was last to leave and I left 40 min after taxi driver and police as I tried getting the cctv the taxi driver left 1st then the police then my 2 witness's then me and at no time did the taxi driver move more than 3m from his car and nobody approached him also when he left he left through the exit which is know where near where his witness's say they were and he did not drive past that area either.

I got told It was my fault when the car was traveling down the wrong (right hand carriage way) side of the road to to hit me! I had a scratched mumber plate and a fog light surroud popped out. He managed £5.2k damage including "whiplash" etc I had evidence where he had been driving too! They were not interested cost me 2 years NCD too!

They take the attitude one presidence has been set of a set type of accident that is IT! They said might win in court but not worth the risk, so settled.

The culture we have now for blame and claim is reaping the whirlwind with all of our insurance policies!

They said this to me however as I have said all the way through this thread regardless of other opinions I was in the car and I know I was not in the wrong so refused to back down and this is where its ended upgoing with them getting detective involved!

Sounds a bit obvious but he may be lieing to avoid blame, I deal with lots of Taxi drivers and while some are honest some are lieing bastards who would implicate their own granny rather than accept responsibility for something !

I dealt with one who passed a marked up traffic car at 66 in a 30, he went trial and as soon as he realised he wasn't getting away with it he suddenly forgot how to speak English !
