PF user sells me a broken gearbox... STILL WAITING
So i buy the box in said thread:
https://passionford.com/forum/ford-r...t-gearbox.html
The guy then tells me after i fit it its never been tested since he had it back off the company and its my problem now even tho its was 'sold to me' as a fully working box.....
DON'T buy from this guy used other members to vouch for him to say he was a decent guy and wont be any issues if there were problems then when i fit it and realise it doesnt work he doesnt wanna know.
I am however looking into taking the matter along the legal line.

WTF why would you even sell something thats not working correctly without telling people.
As said there is no need for that unless your just after ripping someone off.

dont know the seller personally but if you have contacted him and gone through the civil options to no avail, Your next step is the legal one as your stated in your initial post and Im sure all of PF wish you a succesful outcome with this, there is good and bad sellers on every forum.

What a cunt , you have the evidence to go small claims court route, it will be hassle but you WILL win, get the emails & threads printed off ASAP. Ad give me a ring if you want a hand with this.
No point banning the user as it means he cannot reply on here, just restrict his buying/selling privileges?

i dont think he will come back online for a while,it is wrong to rip people off i always look on this site as a community and would never dream of selling faulty goods without telling everyone, whats the point it only comes back to bite you,if it had been me who was ripped off by Ł1500 i would total his car and then him

Devils advocate mode, no doubt I'll get slated by the usual suspects etc but the way I see it from a quick read of that thread:
Doesnt sound like the seller knew anything about the problem when he sold you the box.
He bought the box in good faith, and sold it in good faith thinking it was working.
If its not working now, he's been tucked up himself just as much as you have.
Crap situation, bit unfair on the seller if he bought and sold something in good faith and knew nothing about the issues and now is somehow considered to blame for the fact it doesnt work which he had no way on earth of knowing about? Not his fault at all is it?
I dont see how the seller can be expected to do anything about it other than refer you back to the person he got it from TBH?

Shame there's still so many cunts in the world.
GENERALLY,this is a really cracking website where the decent members 100% back each other with a problem but as with anything else you do get a few bad apples chancing stuff probably in the hope that you'd change your mind fitting it,pass it on then he could claim "it worked when I had it".
I've said it for sometime on here and nothing's ever been done but IMO we should have a proper classified ads system where you have to provide the mods with a valid address, preferably landline number and bank details/proof of address,at least then if the parts were miss sold theres a paper trail to show where the bits have come from.
If your a genuine seller then why not do it?
The site makes it impossible for anyone who's had any association to the motor trade in some way or another past or present to sell goods unless they subscribe to business rates, which generally are too high if your not a full time business, but with paid classified ads the site gets some cash rather than eBay and the buyer knows there's a comeback route if the goods are wrongly described, which they clearly were in this case.
As usual, the mods are doing their best to sort it which is superb, just goes to show that this is a true community website but if banning him and offering the services of someone to collect the debt is the sites only route of comeback then something seriously needs too change.

if the seller has been tucked up its his liability to reclaim shoddy or non completed work not simply pass it on with a stated mechanical condition which clearly it was not hence this thread

I know your only paying devils advocate cos your a good lad chip but the blame now lies solely with the last person to sell it as he's selling as good, the ad says "he" drove it 1000 miles in "his" car with no issues which was not the case.
The last person in line needs to refund whoever he sold it too then chase the boy HE bought it off to get his refund.
Same as of you buy something like a tv off a shop etc,you get your refund from the shop then they chase the manufacturer/their supplier for the difference.
Ok,it's second hand parts and you always take a gamble so it's obviously not quite that cut and dried, but leocos clearly sold this box on as good when as scoobyslayer stated should have been sold as untested albeit then at a far lower price.

To me the logical resolution would be for the seller to put Adam in contact with this Iain, and hope he is a decent chap (no idea who he is) and will help out with taking it back to the company that did the work to get it fixed?
The guy adam bought it off, sounds like he is just stuck in the middle and never personally had anything to do with the box?

Just noticed this post:
The box has done about 1100 miles and 900 off them were motorway miles driving to central day, as for power my car is 450bhp 430lbs... I have no idea what the are rated too you would need to spk to Peter himself
So he's been quite misleading there.
Apologies, Id only read the initial add and then the bit with the copied in PM, I had missed that slyly worded one in the middle.
Seller needs to be giving a refund, and then chasing up the guy he got the box off or the company that rebuilt it for a refund himself then by the sounds of it as he was indeed selling it giving the impression he knew it to be working from personal experience when he didnt.

I saw that, it sounds like the problem is that work was commissioned by "Iain" and then the box went to the seller, and now onto Adam, so its changed hands twice since that company saw it.
To me the logical resolution would be for the seller to put Adam in contact with this Iain, and hope he is a decent chap (no idea who he is) and will help out with taking it back to the company that did the work to get it fixed?

As per say chip i know you get stick on here however i will try to fill few blanks in as i didnt want this thread to get 'messy'
Iain sold it toe chris knowing there could potentially be a issue so he sold it to him considerably CHEAPER than what i paid for it, on the terms theres no come backs he knows what he is buying could be a problem. even if chris did or didnt use the box, he lied and sold it as 'used for 1100 miles working fine'
he then as per pm ADMITS he never tested it therefore misrepresented the sale saying its in good working order, well how can he know if he never tested it? tbh i think we all got screwed here HOWEVER the seller has a duty to the buyer to give the correct information to the best of their knowledge and if there is a problem to rectify it....
He's basically told me tough shit its not his problem i must have broken it as 4th gear was never a issue however the mechanics have only run the box in the air on axel stand to check it works and it clearly doesn't....
hope this helps clear up some blanks
also edit to say by screwed i mean i dont blame iain here i think the company clearly either didnt spot the problem or didnt know how to fix it the company are really IMO to balme here but chris should be resolving this knowing whjat he bought and the FULL STORY..
