Default Speeding update

Right people, as many people sent me messages of best wishes I thought I would update on the outcome.

Solicitor advised me to plead not guilty based on a number of technicalities. I took the decision to plead guilty, as to be fair I did do it, and submit the technicalities in mitigation.
This turned out to be a good move as the magistrates dismissed all of it.

The bench told me it was the highest speed they'd had before them End result was a 56 day ban and 360 fine. Think I got off lightly really. And thanks to working in the same office as my girlfriend, my travel hasn't been too restricted. Now to draw a line under it and crack on with life.

Not interested in the opinions of any moral crusaders, so don't waste your time. To everybody else, thank you for messages of support. PassionFord at its best

Fair do's for admitting guilt, although such a short ban would never be heard of here. That'd be an easy 6-12 months here

But it is annoying the judge can dismiss any technicalities or errors on the prosecutors part. After all, you doing 130 in a 70 was a mere technicality too.

My excuse would be to take the judge out in the car and show him how quick a car comes on boost and how little there is between the 2 speeds in time, unless u had a 1.1 fiesta and it took you the entire length of the M1 to hit 130, lol

Yhep the thousands hes gona save by not running a car for 2 months how about when it comes to insurance renewal and increase his premium?

Anyways its not that bad mate could have been alot worse.

If u got more than 59 days ban u would have had to sit your test again.

Got lucky. Prob just an SP?? code on the licence.

I've been done a few times lol had a 28 day and also a 42 day ban previously

You were quite lucky there, good result for you.

Last month i got 6 points and Ł295 fine/costs for 100.2mph in a 70 limit, i think i'd have preferred a short ban instead of the points.

Seen this a lot on pepipoo and with other car enthusaists last couple of years. Most magistrates are more interested in the fact youve broken the law rather than some technicality to try and get out of it.

To be fair i agree with them (and i dont mean this as a dig at you), and i dont mean traffic offences but criminal cases in general, far too many get off because some stupid I wasnt dotted or a T wasnt crossed even though the evidence in any reasonable persons eye stands for itself regardless of some piece of paper or technicality in case law.

Sure in border line cases the technicalities are important, but anything else it just hinders true justice. If youd been charged with doing 77 in a 70, then sure technicalities might be relevant eg an innacurate speedo makes a difference, but at higher speeds or more blatent crimes, a small technicality makes no difference.

The ones that used to annoy me were things like people claiming under the 14 day time limit rubbish for FPN's. Regardless of the time, the person was still speeding and should take responsibility.

However i do see why people do it as over targetting of motorists for petty offences does breed contempt for the law and understandably so.

The whole speed limit system needs urgent review IMO as its just not fit for purpose for modern cars and roads. The fact you didnt (and many dont) get dangerous driving added to the list of offences shows that speed alone isnt the "evil sin" the authorities make it out to be.

however a judge would say it was your responsibility to be maintain proper control such that even under heavy acceleration you can stop at the speed limit. You wouldnt want careless driving added to your speeding conviction

depends on the type of ban. very few bans have a mandatory retest/extended test. However a magistrate can for many offences order a retest.

I got a ban of 7 days, Ł60 fine and no points years ago for an incident with no insurance (admin fuck up thanks to Adrian Flux). I was looking at the max of 12 month ban and a hefty fine but due to police cock ups got off lightly.

Not quite justice and I pleaded guilty but hey ho.

Didnt hit my insurance as much as 3 points for speeding would of.

IMO if the public are not allowed to make mistakes, then no way should the law be allowed to make mistakes when preparing a prosecution file.

There was a ballbag cop on a local forum who had that attitude. Even to the extent where cops got dates wrong, registrations wrong, locations wrong, names, DOB's wrong etc etc. Yet he still thought it right that despite major errors, the prosecution should still be valid.

Should it fuck. If a dumb ass cop cant even take basic details down accurately, how the fuck can they be trusted with anything they are saying or writing down ? Isnt evidence used for prosecutions supposed to be based on fact, and accurate ?
There are enough cops making up shit to nail people, we dont need to encourage it.

IMO if a cop does make mistakes like that, then their ability to do the job needs questioned. If they are so incompetent, then no way should they be in that job in the first place.

We arent allowed to make mistakes on the road, so no way should they be allowed to when trying to nail us.

read what i said.

No matter what technicality you try and pull out the bag, you cant deny that 130mph was speeding

even if you say the camera wasnt calibrated recently, it might have read "only" 120mph if correctly tested.

120mph is still speeding

All speed measuring devices are innaccurate to a degree, its whats considered acceptable that matters.

for cases of gross speeding, such accuracy tolerances make no fucking difference to the fact that the person was clearly speeding. To say otherwise is stupid.

Its the same in many other areas of criminal law. Eg cases being thrown out because of spelling errors and other such pathetic administrative errors. Completely stupid. Just correct the fucking paperwork or admin error.

Luckily many magistrates dont give a fuck about technicalities in clear cut cases and rightly so IMO. eg in the old days CCTV had to conform to certain standards to be admissable in court. Nowadays that is simply not the case. If your camera shows high quality footage of cuntface breaking into your house, it matters not that the time stamp was a few minutes out or it was filmed on a uncertified private camera system. The footage stands for itself.

respect to you for pleady guilty and taking the punishment. technicalities or not, you know yourself that you did the crime and should take some punishment for it to be morally right. i'm doing the same and am in court on the 1st august to hear my punishment for 63 in a 30.

After being fucked over last time I was in court despite admitting everything and pleading guilty... if I am ever caught doing anything slightly fruity again then I'll be going down the 'No Comment' route at the scene and unless my lawyer can cut a sensational deal, I'll be pleading not guilty and prepare to go down fighting.

Was a touch and I'm well into the ban now. Only another 14 days of bike and train left as missus drives me 2 days a week, handy working in the same office.

Unfortunately my mate hasn't had his papers yet so he may get banned as I come off mine.

Ref insurance, I called them as soon as I'd got my mum to drop my car back to my place. They couldn't have been much less bothered by it. It wasn't drink or dangerous driving and a first offence.

Missus is driving me to work in my car tomorrow. Should be fun as it felt flat to her last time compared to her Clio so she burried her right foot..... and it came on boost. LoL
