Default Advice Needed

Earlier this evening i was out at a restraunt with my sapph in the car park and some silly OAP caught the rear quater and bumper and smashed the rear light.

got his number and the bloke admitted fault etc but just wondering are they likely to write it off as ive heard they wont use second hand parts or filler etc and i dont think they will get hold of a new cossie rear bumper and will probabaly struggle to get a new rear quater or rear light

if the insurance do write it off will i be able to buy it back and do the work privatly cause i really dont want to lose my car.

Any help and advice appreciated

Be honest mate,hardly worth a claim,with your excess,will repair have a light if you need one,

you will still have to pay your exsess up front and claim it back,if all goes ok you will come out tops,if not it will be a lot of hassle for a few hundred pound repair,what is your excess

i wont have to pay though cause it will be done via their insurance

you still have to pay your excess when you pick car up from repairer and your insurance company claim it back from there's if you have legal cover,if not you may have to claim it back your self,now is it a standard saff,or is it a cossie,and are you on a specialist insurance or just a normal policy

its a full cossie replica but all mods are declared
im with adrian flux as a specialist policy (pretty sure of this)

it doesn't look like it's a lot of damage, but the price will rise sharply when you get the paintwork done

go through the insurance, at the very least you'll have a courtesy car while it's out of action and it's not a massive dent, easily fixable, just the paint that's going to cost shedloads as they'll have to match a whole lot of the car

when i had my saph dented, it was just the quater, but when it came back they'd painted the quater, the bumper, the bootlid and spolier, all in different shades of white and it took 6 months for them to finally get it right, and then i wrote the fucker off the same night

If you go through the insurance you will pay slightly increased premiums for the next 5 years as non fault claims still bump your premium up.

IMO not worth claimingin real terms so your now stuck with the honesty of the other party to see if they will cough up.

yes but its a cossie replica so in the eyes of insurance a £500 sierra....

it will likely be written off, worth less, cost more to insure as its a write off plus harder to sell etc all on top of the fact that CUNTY insurance companys claim they have evidence that a non fault accident makes you a higher risk so he will pay over the odds on his insurance for the next 5 years....

so i still reckon its not worth claiming.

im going to try and see if they are willing not to go through insurance and just pay up cash

cause i really dont want the insurance to write off the car and i want the car done quick

NOTHING ZERO ZILCH to do with legal cover or not, your insurer is LEGALLY obliged to claim the excess back where it's not your fault or put it down as a no claim on your part.
Often in cases like this each insurer will pay it's own insureds claim on a knock for knock basis, get IN WRITING first that your agreement to this will in no way affect your NCB or premium, insures lie out their arse, it happens this way as litigation is where the real costs lie.

No they don't not at all not one little bit, but some insurers TRY, it is ILLEGAL though.
My gf's astra has been written off 4 or 5 times now, never seen a rise, it was written off last november/december no rise in fact a £25 reduction this year, all been through insurer.

This is what I'd do, but also importantly get him to sign a declaration that he has paid this money, as it will mean he has no chance to "chance his mind" and say it was your fault and claim from you.

Doesn't cost a single penny more, in my 28 years of driving I've had 5-7 cars written off, all repaired by myself/garage after receiving the money from other side/insurers not seen a penny increase in premium of any knock on PNCB.

It is YOUR car, it does NOT belong to your insurer, should you wish to go through them and make a claim, they CANNOT settle the claim without your agreement, so simply state that it is to be settled on the basis that you retain "title"(ownership), they will be very unlikely to even try to charge you for the "salvage" due to the value of the car and their own accredited disposal costs, the gf's astra has never been charged for in 4-5 claims.
Any repair will only use parts that you are happy with, where no new parts exist you will be asked about whether pattern or s/h parts can be used.
Just take the money from the insurer, and repair yourself/garage etc.
Just be wary if it is AVIVA as they are at the forefront of dirty tricks at the moment, just like Nu were.
