NOTHING ZERO ZILCH to do with legal cover or not, your insurer is LEGALLY obliged to claim the excess back where it's not your fault or put it down as a no claim on your part.
Often in cases like this each insurer will pay it's own insureds claim on a knock for knock basis, get IN WRITING first that your agreement to this will in no way affect your NCB or premium, insures lie out their arse, it happens this way as litigation is where the real costs lie.
