As title, is it about 11 hours break between shifts?

either way I'm finishing 'work' at 9.45 tonight and starting another 13 hours at 8.30 tomorrow morning...

In which fucking workplace?

Lots of companies work on 8 hour shift patterns for example, with 3 shifts a day.
But not all.

There must be about 8 gig of different possible shift permutations theoritically.

What does your contract state? In mine I'm contracted to 'work whatever hours are necessary to get the magazine out on time'!

Jim, if his shifts are 6 hours long, he could have a 6 hour break between them and still not break that directive, there is no law stating how long should be "between shifts" as it would need to take into account the length of the shift too.

chip, yup as long as its 11 hrs total in a 24hr period (not a day, just 24hrs sampled at any point) its ok

and dan, you can refuse to work more than those hours and they couldn't descriminate against you for it legally.

real world says you probably woouldnt be the golden boy and wouldnt last all that long tho... lol

I think it is all down to individual contracts isnt it?

Even though the 11 hour break comes into Force, contracts can still over rule that.

There have been many evenings when ive finished at 9/10pm, but started again at 7am!!!

I belive the directive is merely stating your rights, you can always choose not to exercise your rights though i suppose. Especially if you just keep your mouth shut and dont complain about your rights anyway

Ive done 36 hours or more straight without going home at work when nearing a project deadline on many occasions.

maria, you cant have an valid employment contract that states you have to break the EWTD so no a contract can't over-rule it.

as chip said tho, most people just keep their mouth shut

for example i'm 24/7 on-call which i get paid a rate for. im sure that probably breaks the EWTD but i'll be fucked if i moan about it as it doubles my salary

I think you'll find that to be wrong for the railway industry.

The Lord Hidden enquiry into the Clapham Junction crash reccomended that all railway staff have a minimum of 12 hours rest period between turns of duty.

This was then made law for all safety critical railway staff and still stands to this day.

I wasnt saying it applied to all industries, if you see my first reply on this subject its to say that no one can answer without knowing about his company.

I was just giving one example of a legal shift pattern with little time between shifts, assuming that there are no other issues that contradict it, air traffic controllers for example have very strict rules for hours and make your train guidelines seem very lapse by comparison IIRC.

Where I used to work we used that 11hr directive to force the companies hand into us continuing on a 4 on 4 off basis rather than a continental shift arrangement of two 8hr nights,back in for two eight hr afternoons and then 3 eight hour morning shifts then 2 days off.

Some of the factory decided to stay on 7 on 2 off and exercised their "rights" to work the pattern.in this climate I'd work whatever I was asked to keep a job as it's tough at the moment.
