Default Driving a car with no tax

right basicly with a bit of luck i'll be px'ing my focus st next week but the guys coming over fron ireland and wants to meet roughly halfway to the ferry port.my focus has no tax at the minute as i've never applied for the logbook in my name as i was just repairing it and selling on and didnt want to add another name to logbook(1 owner car) and shell out extra cash.the car will be insured and doesnt need a mot yet so what could happen if i',m stopped on way to meet him, could the police impound it?

just the risk you take.. police arnt interested in the situation, if you put that car on the road in their eyes your breaking the law so will take it off your hands for you. or you might not get caught. its a gamble. just takes one ANPR camera tho.

Depends if the car is SORN or simplay a month out of tax normally.

SORN then your buggered.

I've heard of others just with a fine and back paying tax if it's slightly out of date.

Tax it, then when you drop the car off take the tax disc out the window and claim back the 5 full months remaining. It'll cost you 20ish quid but will be worth it!

i would have done what rich 170 said, but as the car aint in your name the tax disc will go to whoever is registered on the v5 which means you wont be able to send it back for a refund (unless you can get the tax disc back)

do you know any motor traders? if so cant you borrow their trade plates

Can't you just tax it with the green slip off the logbook at a post office? When I claimed tax back for my old car it had already transferred into the motor traders name, just filled in my name and address on the refund form.

Hiya,

The police powers under section 165 of the road traffic act; They will only seize a car if it is un-insured.

If the car is insured (and registered irrelevant who to) it cannot be seized.

If you drive a car un taxed, you commit the lesser offence of driver a vehicle without displaying a vaild vehicle excise licence - this is dealt with with a £60.00 non endorsable FPN. - The same applies if you have no MOT, (unless its unsafe then it may be prohibitted).

Does that help?

Leigh

The information is from an experianced RPU (roads policing) police officer..

If its insured, you have no issues - however it will flash up on ANPR cameras, so ensure you have your 'day insurance' paperwork with you incase you are stopped...

But as he's the driver, its up to him to make sure the car is taxed/mot'd/insured etc.

Or the police ring the new owner, he denies all knowledge, then geordiegooner gets done for theft

I'm sure that with day insurance the car actually needs to have a proper insurance policy in force....

Say like you borrowed my car, my car would need to be insured by me before youi can have day insurance on it. Thats what they told me when I questioned it with the insurance company anyway.

i've used tempcover.com a few times now for a days insurance and even taxed cars with it and had no problems with them saying the car has to have a proper policy theres even a bit on the online form saying you want the insurance for driving a car you've just bought.
