Default false injury claim against me????? advice.

ok im gna try cut the story short.

in october 2008 i was involved in a car accident.

it was a non falt accident, the driver was racing with another driver and i was indicating right to turn into my road late at night and no one was in my mirrors then as soon as i turn one car overtook me and the second car went straight into my door. wrote me car off.

he also wasnt insured
etc etc etc.....

eventually it went to court because i had to claim off my own insurance etc etc.

he actually got charged and done for
DRIVING WITHOUT DUE CARE and NO INSURANCE. licence endored 6 penalty points + disqualified for 6 months,

okkk thats over thank fuck.

i now get a fucking letter through today from the passenger from hes car trying to claim off of me. ok first of she did break her arm.

buuuttt that was hes fault, i am the fucking innicent one, its unbelievable .

she basically lied and said my vehicle was parked and stationary in the road. as a result there had been a build up of traffic with all the vehicles approaching my stationary vehicle and having to move around me. as she approached me and began to move around me i suddenly pulled out onto the road without indicating hitting the front side of clients vehicle. they was also informed that i was on my mobile phone at time of collision.

that whole thing is bullshit. thats fucking fraud

i have spoke to my claims/ insurance and they said she hasnt got a leg to stand on,

but im still worried about getting some sort of fine for actually doing nothing.

the inpact where he hit me was crazy, so how the fact could me pulling out on there car doing 10mph or what ever cause that lol, this world is crazy

I'm confused. If the other driver has already been found guilty and charged and your own insurance company say she hasn't a leg to stand on whats the problem?

because if you had a letter from a soliciter, reading that she completly lied about how the crash happened your initial reaction is to think WHAT THE FUCK.

yeh it has been settled in court but its the passenger trying to fuck me over. put your self in my situation.

thats why im was concerned.

i just didnt want to be stiched up by some one basically commiting fraud.

yeh she had a broken arm, but because he caused it,

if you've already had legal advice, and they say you will be ok, don't worry about it.

go to the docs and say the letter is stressing you out, and say the letter is bringing back memories of the accident then put a claim in against her...see how she likes it.

If she broke her arm, she's within her rights to claim I think, or have I read it wrong? Although if he was done for dangerous driving, I wouldn't even entertain them by reading letters unless important to you, they'd be straight in the bin.

As the driver has been to court and found guilty, then surely the girl in the car is making a fraudulent claim; she cannot claim off you if the car she was travelling in has been proven to be at fault

speak to the fraud dept at the police and see what they say

as much as i DO have that sort of attitude normally, its the fact its a soliciter, i didnt want to ring up and start raving and shouting or just ignore the letter because its LEGAL DOCUMENTS,

personally i wouldn worry about it as the court has already put the blame on the driver not you. Direct the solicitor to the driver.

If the accident was Ricky's fault yes she could but it doesn't sound like it was and she is trying it on. It's the risk you take getting into an uninsured car IMHO.

She can't... Probably trying it on because the other person wasn't insured and maybe she got nothing that way? I'd be binning those letters me, and getting on with my life.

but i need to send it to my claims people/ insurers so they can sort it.

i know if i throw it away it could come back at me, just because its legal documents

She should be claiming against the person at fault though, which in this case is the driver of the car she was in, not ricky_2006.

Some people will try anything. My mate had a claim made against him, but it wasnt even him. Two guys were trying to claim against their own brother who had apparently reversed into another car while these two were in the car with him. The letter said they were suffering trauma and having flash backs to the incident!

Somehow their solicitor came up with my mates name and registration. The different surnames would have been a give away to me

Firstly - You cant get a fine or points on your license no matter what happens as you are past the 6 months they have to summons you for a road traffic offence.

Secondly - You wont personally be liable your insurers were

Thirdly - If your insurance cant get out of that one then they have some VERY shite lawyers



There is NO way in which you are personally liable in that situation, so dont worry about it.

Cant imagine any no win no fee company would get involved in that, as they arent likely to get paid!
Unless its just a standard letter that they fired off to ALL involved drivers as a matter of procedure and its actually one of the others they intend to claim against.

no coz it was only us 2 involved and the cheeky cunt said I WAS PARKED UP ON THE ROAD. well its a main fucking road and it was the right into my road aswell lol so how was i pulled up on main road. she really has a cheek. hope she gets fined for fraud
