my dad has a fiat coupe and the gearbox packed up a month ago. he searched around on the internet and found a place called 'chadderton salvage' they werer advertising a re-con box for 299 with a years guarantee he asked me if i could order it for him and pay as he hasnt got bank cards.
he never recieved the box and has been calling them asking where it was, they fobbed him off saying the courier had lost it blah blah blah.
they told him they would refund the money,,, still havn't got it!! i paid with my bank card so i'm guessing theirs no come back's?

how exactly did you pay for it mate?
If its credit card you are covered for non receipt of goods, unfortunately debit cards dont have this cover. If you did pay with CC, phone your provider and ask for a chargeback.

i know mate, if only my dad had done a bit of research first, but he was desperate to get he's car back on the road.

Its near me that gaff, not been there that long as its in the old transport yard.

To the OP; Debit card = little / no protection from anything like this, credit card is different and does offer protection.
Your current best course of auction is to send a "letter before action". Highlight the problem, the required solution, the time frame in which the solution needs to be applied (remembering to ensure a reasonable amount of time and finally the outcome should the solution you suggest not be complied with - in this case, litigation via the small claim's court. Ensure your send the letter by recorded post.
Should they fail to refund your money within the allocated time then go to:

And start a claim with the small claim's court. It'll cost you about Ł30 but it is well worth it.

Sorry, but it definitely won't be.
The appropriate legislation that allows you protection when using a credit card is the Consumer Credit Act and that has no bearing whatsoever on the use of a debit card, regardless of who the issuer is.
For future reference when purchasing goods or services that cost between Ł100 and Ł30,000 you should always pay at least some of the amount on a credit card, then, if it all goes wrong the credit card issuer is jointly liable with the supplier for the whole amount.

If you want to be arrested then disclose the details on a forum where someone offers to "help", that could be the likely outcome.
Much better is a few more options.
1. if he sells s/h cars arrange a test drive of a car that is more than the value of the box, now keep the car, send him a letter telling him it is in lieu of payment/refund, also inform plod as he'll report the "theft", so long as you can prove the debt is owed, as not received the goods then it is a CIVIL matter 100%, you are 100% entitled to do the above, as is anybody owed a debt by anybody.
2. file a CCC, county court claim, when you get judgement if he still doesn't pay hit him with a garnishee order, this seizes ALL his finances present and future, and also future assets, or could opt for possession order against him for alternate goods.
This way you are squeaky clean, and legal, not forgetting he has YOUR address, so any "heaviness" can and does work both ways.
