Anyone know of Baliffs that buy debts, Lent a so called m8 some money and he is refusing to pay any back, if not will try the small claims court.

You'll lose loads if you go thru bailiffs - most debt collectors will only pay about 50p in the pound for the debt they buy, and depending on the age or percieved difficulty of collection this may drop to 25-30p.

Its a tricky situation I guess, but can you not get your mutual friends to pressure the guy into paying back (guessing mutual friends as you said he was a mate), or get a couple of large persuasive mates to pay this person a visit?

Bad though if someone you thought was trustworthy has ripped you off.

What a tosser! He shouldn't of took it if he couldn't pay it back, whatever happened to people with morals? If he drives, then take his car...

 

Best bet is to forget about it and move on....you will not see the money unless you get someone to smash his face in!

A best mate of mine refused to pay back Ł3K to me which is bad.

But what made it worst was that I was out of work at the time and had no money to my name. The money was on a credit card of mine and an overdraft on a bank account he was using of mine.

First thing I had to do when I got a job was start paying the debt off.

This was a bloke who I would "treat" to holidays/days/night out. Let him drive my 500Bhp Escort cossie when he wanted to. Take his kids out, baby sit his kids. Lend his ex wife money so she could pay her rent arrears instead if her and the kids being thrown out....the list goes on and on...

If any dodgy fucker here wants to buy that debt then PM me

Very similar situation m8 but double the money and thats what he owes me, the small claims court will take it on, i just thought i would ask on here incase someone had been in a similar situation and got a good result.

go through small claims court think it only costs Ł75 to kick it off

 

Im a bailiff (someone has to steal your TV and make your kids cry if you dont pay ya bills lol), You wont get anywhere without a county court judgement, anything you get through the post from debt collection agencies are nothing but threats without substance.

You can fill out the forms for the small claims court online, they will write to him and ask for his side of the story which will vary from yours. Can you prove it was a loan and not a gift? It can get tricky but its usually straight forward. Then get in touch with a bailiff agency and they will recover your debt by seizing goods if they have too, you get 100% of your money back if they get it and any charges are billed to him.

Problem is that nowadays its easy to go bankrupt and you get nothing, he can make himself bankrupt just by filling out a few forms at the county court, within 12 months he will be discharged and he will be able to keep a lot of assets like his house and cars even if he has a mortgage or loans secured on them. Finance companies deal in money and tend not to want any assets, to most they prefer to write off a debt than sieze a car and throw it in an auction.

As above if going the court rule the man deciding doesn't know you or the alleged debtor, so can ONLY go on the evidence before him.
Court cost vary and are FREE to some, but any extra expense can be added to the bill, as can interest under the county court act, but again EVIDENCE is the key word.
Try and shame him by asking his parents, but FIRST try to get proof even if it means tricking him into at least admitting it, if you don't already have proof.

Hope you get things sorted out Steve, it's never a nice situation to be in, a 'mate' did it to me years ago, he didn't get away with it and i've never spoken with him since, saw him in a club one night and threatened to kick his head in then and there unless he dissapeared!

So is your mate saying he 'wont' pay you back or he 'cant' pay you back? The two are obviously very different, although still wrong. What reason has he actually given you for 'refusing' to pay it back then? Is he saying he doesnt owe it you or what?

 

if it comes down to it, say he asked to borrow money off of you to buy something like a car or a telly or something
at least you'll have something physical to remove other than his gonads when it comes to collection time

 

Him and his wife know they owe it, she was paying Ł50 a week which was ok till two weeks ago when payments stopped and when i asked why she said she couldnt afford it and it was his debt so she said she wouldnt keep paying it for him.
