Default Tyres Slashed Legal advise needed

hi all,

ive had so much trouble with M.O.T'ing the cossie this year it really takes the piss. I went to takke my car to get re-MOT'd, it was garuanteed to pass as already repl;aced the one part it needed.

I droped it of as i had to work at 6am outside the garage and then got a call at 8 saying the tyres had been slashed.

However, the problem is; it is not insured as it is S.O.R.N, the car was apparently not parked on the garages property, so im fucked.

The Tyres were goodyear F1 225 35 r18 not cheap as you can guess and as good as new.

Is there any way i can claim some money from this, i reported it to the police and they have given up as their are no leads.

Any suggestions much appreciated

sounds very unlikely.

Sounds like its a cough up and move on.

OOC - the garage dont sell tyres do they!? Could be a scam to get you to buy four from them as moving it without tyres could be hard.

although youre lucky having reported it to the police that they didnt do you for driving it with no insurance!!

I think you may have to put this one down to experience m8

i said it was toed there mate

experiance as in dont leave your motor parked outside the garage before the garage is actually open? I had no other choice mate as was working

Pay up mate and forget about it, ain't worth claiming after you get it insured.

Garage will not pay sod all - do they sell tyres by the way? Did you have any issues with them? would they have had reason to give you some stick, knowing you dropped it off and had gone and that they could say "well we tunred up at 8 and it was like that"

Just seems an odd time for a tyre slasher to be out and about, usually happens in the night, and all four done? any other cars about, did they get done.

Wont do any good, as no proof, but doubt i would give the garage the money for new tyres, would rather get a spare set of wheels on it and take it away after they have mot'd it

A car can be insured whilst SORN'd. You do need to get an MOT to get tax after all so there is no legal reason why you cannot claim on the insurance. How much is your excess and are you protected NCB?

If you do claim, then you WILL need to keep the old tyres to prove condition, and if they are getting down (below 5mm normally), you would be expected to contribute towards the cost of replacement.

However, if it was not insured, down to you.

I agree though, I would not let the garage sell you the tyres, although they would be within their rights to charge you storage after 24 hours have passed since the MOT being done, so you might want to be quick about it.

hard to admit, but you'll have to take it up the arse and get soem new rubber on it

if there is some cctv about the place then that might do something, but even if they found the person responsible they won't be paying for your tyres

the garage shouldn't be getting your business if thats the way they have responded though, so this "garanteed" pass with no questioned asked might give you a bit of leverage if they tell you to fuck off and don't give you the ticket even with 4 shonked tyres

And the fact you were driving uninsured

As said SORN nothing to do with insurance.
If you parked it where the garage asked you they are liable as it was in thier care, you can rightfully expect your car to be taken reasonable care off as this is a legal duty of the garage you entrust, ie they have aduty of care.

Not nesacarily - especially if he left the car there before they opened. I know my company aren't responsible for any customers cars if they are left with us prior to us opening and us getting in - and even then they aren't our personal responsibility untill the customer signs the car into our care. So if they drop it off outside our place before 8am when we aren't there, and then when we come in it's been vandalised or stolen, it's not our responsibility.

Its debateable if lukeytheduke had adequtely discharged the responsibility of the car into the care of the garage. However, when compounded with the fact that the car wasn't insured, I think in this instance, lukeytheduke doesn't have a sound basis for a claim against the garage.

I think he is a pillock personally for no insurance but it makes no difference to any claim he might have against the garage.

Sounds silly, but have you actually GOT no insurance on it or do you THINK you have no valid insurance as the car has no tax, even though the insurance may still be getting paid?

There is provision in the law to drive without tax so as to go to a pre-booked SVA or MOT. This would not void your insurance.
