Default Criminal Record in the workplace

Just had a friend on the phone who has applied for a job, in the advert it stated that a Full criminal record check will be carried out

Anyone know how thorough and far back they go as he was done for something about 14 years ago. Its not for a high exec job, just site work and the odd repair in domestic homes. He's a totally stand up guy (even sells the odd dvd, tv, jewellery pretty cheap ...joke!)

I know my company dont go that far into it as I got security clearance for Palace Residential & Military venues this year, but mine was 18 years ago.

Any good constructive advice or knowledge on here please?

depends what it is, but i thought some stuff stayed on record for 5 years?

I was under the impression it was 10 years unless it was violence, noncing, armed robbery, etc ...but then again I dont really know for sure

If its on the PNC they will find out.

I presume its some kind of job where access to secure sites are required??

Normally such things are covered by the Rehabilitation of Offenders Act which details how far back you need to declare certain convictions to employers.

Having "previous" isnt necessarily a bar to such jobs as they take into account how long ago and seriousness of crime.

It depends on the sentance. From memory I think a conviction that gets you imprisonment over 5 years stays on for life and then most other things are spent after 5 years. However they will all still be on PNC but will not be disclosed to the employer unless the job requires developed vetting ie working with children etc and thats when everything can be disclosed including intelligence held by police on individuals.

i know for airport jobs at heathrow they go back 5 years mate, duno how thorough it gets tho.. hope that helps a little

If its a CRB check its back to Birth but also depends if its a normal or enhanced.
Depends if his working with vunrable (kids / old people)

They do but under law certain crimes become spent after so many years.

That is so that rehabilitated offenders are not penalised unfairly for what they did years ago. For example if you had a few "wild" years when you were in your late teens before you grew up it would be a little unfair if you were unable to get a decent job for the rest of your life.

it depends on what they unearth

jail time is supposed to be spent after 5 years from release, but pold will still come up with the smug "have you ever been arrested before sir?" line

most things you can get away with, although if it's in the crb they'll know about it

Im guessing it would be 5 years maybe? Im still doing my vetting, they wouldnt expect a girl to be a girl to be convicted of any crimes from under the age of 11 surely?

10 year's but if you have been done for other thing's in that time they can stay for 20 year's. If you've been in prison for anything it stay's on your record for life

Just been told my the managing director that the law is now 10 years back. I think by that he meant that it used to be 5 but it is currently 10 years

I take it that applies to non serious (if there is such a thing) convictions and short term jail sentences?

Now that the CRB has become a commonplace item regarding recruitment, the Rehabilitation of Offenders act is merely a joke now.

I myself have been turned down for jobs a couple of years back and had a follow up enquiry by the Licencing department of our council for a conviction i had in 1996 for an offence 2 years earlier, That was supposed to be spent as my solicitors letter stated.

Now I thought the CRB check was restricted to only companies that NEED it for the work they do. Any dick and harry company is NOT supposed to have access to that information. Thats written in law

Generally other than governemnt organisations its things like health, schools, old people, military contractors, government building contractors etc.

Shouldnt get a CRB for Maccy D's or sainsburys!!!! or similar!!!!

it depends on what type of conviction it was, eg:fine,probation,community work or prison. if its prison again it depends on the length of the sentence and nature of the crime.
i know that up to 12 months in prison takes 7 years to be spent and 10 years before it's wiped off your record (alledgedly!!)
i know this from experiance too!

Depends how the company see it, some use the 'contact with children' excuse, basically just a blag for them to get as much info on you as possible

Hiya Lee, long time no hear, hows things?

I guess he'll find out whats what tommorow morning as thats when the interview is ...its for doing cavity insulation so fuck knows why they run or claim to run a check
