Had a situation last week where i was reverse parking at the side of a busy road and was straightning up and so needed to move car out a bit. Checked my mirrors nothing coming so i switch to other mirroe to watch how close i was getting to kerb. All of a sudden a car goes past and scrapes the front side very slightly. Was a woman driving a volvo estate. She pulled over and we both looked at our car. I apologised for the car sticking out (slightly) and she said its ok i was nipping on a bit as im late for a meeting. Having looked at both our cars , both had minor scratches, i suggested that we both pay for our own paint work. Shes said she would see how much it was first and took my name, phone number and reg no.

Now the complicated bit.

It was my girlfreinds car but i am insured under my own policy. Earlier today she received a call from her insurance company sayin there was a claim being made against her. She explained that i was driving it under my own policy. They then advised her that i need to phone my insurance company. Which i will do tommorrow.

My question is were do i stand on this ?

The woman never even phoned and this is a week on. Id of probably paid for her damage if she phoned. Im not wanting a claim to go against my name for all its worth

I have the feeling she has maybe took it to an expensive bodyshop and they have quoted her through the roof and shes thought feck this im not paying or her hubby ?

no didnt take em. she said she'd call if there was a problem. as i said i was happy for us both to pay our own way. there were crappy little scratches !!!

girlfreind cant even see it on hers !

the gf did get her name and insurance company details when her insurance company phoned today

Try ringing her and explaining the situation and that ur willing to pay to save on paperwork, etc. etc.

Worth a try coz at least she wont be paying for it

seeing as she never phoned im reluctant to accept responsibilty and pay for it

I wanna know where i stand once i explain what happened to my insurance company ?

I s'pose in theory, it can be looked on as her running into you since she was coming up from behind you so in theory she is liable and she was speeding but that can't be proven. That's in theory anyway but in practice, i'm not sure tho

If i was you mate i'd have a proper read through you insurance policy.

I was driving my mate girlfriends car once and someone reversed straight into me and took the front bumper off. I thought i was insure through my policy, but when i phoned em they said i weren't as i didn't have a certain option on my policy. Luckily it weren't my fault so didn't matter in the end, but still worth checking it out before you go accepting any responsiblity! Cos let face it if nobody saw, and there's hardly any damage on you mrs car, how's she gonna prove it!

If the claim goes against you, your insurer will pay for the other driver's car, but not for your girlfriends - cover provided while driving another car on your policy is only for 3rd party risks.

Your girlfriend would have to claim against you individually for her damage if that were necessary as her insurance won't cover her either, unless you stole the car!

Hope you sort it out mate.

Don't admit liability until you've spoken to your insurance firm and explained the situation. They'll tell you waht to do with regards to blame etc.

On a similar note, one of my mates got knocked off his motorbike before when a car pulled straight out of a junction into the side of him and knocked him to the ground. She then drove off, Luckily a guy on a fireblade saw what happened and chased her down and made her come back. My mate was fine so didnt pursue it further. Just glad he was ok etc etc. a month or so goes by and he gets a letter through saying the woman is suing him for affecting her mental stability or traumatic stress bollocks.

To be honest im not saying its 100% her fault. Maybe i should of been watching my other mirror more carefully instead of fixing my interests on the kerb side. I was moving in and out to try and straighten up in a tight spot. It happened that quickly and slightly its hard to tell exactly whos fault it was. The contact was made when i edged the car out slightly but she must of been hell close to the side of the road to hit me. I was happy with shared responsibility and we pay for our own

For insurance purposes, I think you'll find that you were manoevering into a tight space when you saw this car approaching quite quickly so you stopped and waited for her to pass. Then you were astionished when she clipped the front of your car!

Think she could be up for Due Care and Attention there aswell mate. As i'm sure when you take your driving test your told not to drive closer than a doors width to parked car, incase someone opens there door or PULLS OUT!!
