Default Legal Advice - Criminal Damage

Was out last nite with a few mates. Now the nite was going well unitl we were rejected entry to a nite club. As a result my mate stormed off pushing the sign for the nite club over which consequently got damaged.

The bouncers grabbed him and said you pay for the damage or the police get involved and get him charged for criminal damage. On closer inspection the sign was scratched where it had it the pavement and took off the powder coating. These signs were brand new as they got the invoice out for them and tried to charge him nearly £500 for a new sign. However, we managed to convince the bouncers that its only a spray to fix and would cost a fraction of the £500. They would only release him once they escorted him to the cashpoint and handed over the cash. They then gave him the receipt for it and then let him go.

Do the bouncers have the right to threaten and make him pay or do you think my mate got an easy ride so that the police did not get involved?

fpmsl, the bouncers had no right. But i bet it taught your mate a lesson

The £500 was probably for the material, labour, paint etcetc, so a repair job would have cost a fraction, say £100?

Do you think they would even both trying to press for criminal damage, solicitors, court appearances etcetc for £100? No

That £500 has been split between the bouncers and manage

Dont know mate, the police up this way listen to the bouncers more than the punters so they could have had him pay the repairs through the cops!! He probably did the right thing! bet he wished he never pushed the sign now eh!

I would have got the cops involved rather than pay them anything.
Your mate could claim he accidently knocked it over or was just pissed off.
Depending on the cops he could just get a warning and nothing more.

should have let them call the old bill.no way these bouncers would appear in court as witnesses.most of them would be working for cash anyway,so would not want the hassle.a bloke i work with,his wife is a soliciter,reckons if ever you get nicked deny deny deny and demand the duty soliciter(who is free of charge).theyll tie the police in knots and its surprising what the'll get you off of.his words not mine! but how many of you have been nicked and for something trivial and heard" come on you might as well admit it now,youll only make it worse for yourself", yeah, like fuck!!! perhaps if your mate was in this fram of mind better they didnt let you in only joking

The cells are ace, jus put the blue plastic matress on top of you to keep warm, and go to sleep, job done, they let you out next morning, and jus walk straight to work, thats what i do

I'd have got the old bill involved, probably would have turned out they shouldn't have the sign there anyways, do they own the pavement as well as the club?

I was working as a door man in the Bristol Academy and I had a very similar situation, I ejected someone from the club through the front door and as they were going they punched the glass door and it smashed.

I immediately dragged him back inside, management was called and he was given the option of going to the cash machine and drawing out £200 (The cost of someone to come and fix it there and then) or the police would be called and he'd be up against criminal damage.

He decided to wait for the police who turned up and repeated what we had said, he then went and drew the money out there and then

Your situation sounds very similar, although very petty over a scratched sign.

They gave you mate the option of what he wanted to do and he obviusly thought it was serious enough to cough up.

Don't forget it was probably all on CCTV as well, so they'l be able to prove whether he did it on purpose or not

I'd of shouted "suckers" then ran like fuck. I would of thought the bouncers were takin me round back for a hiding.

fooken hate the majority of bouncers. almost got killed by one the other week!!!!! where he was throwing me out the club, he decided to do it by lifting me off the floor in a choke lock then carrying me to the other side of the club. I was semi blacking out, on the verge of completely losing consiousness.
