Default what would you do?

Last night the neighbours bin took off in the wind and hit the front of my 135I, broken the headlight mount, damaged paint on bumper and bent the wing,


I don't see how I should be out of pocket for best park of £1k for the repairs when all I did was park at home, I also don't really want to claim off my insurance,


I think he's a knob for putting his bin out when its blatantly really windy here, has been for days, which is why mine stayed against the house, but where do I stand? All he says is contact the council as its there bin

id say this happens a lot seeing how many bins are just left on the street.hard to know where to begin but with the neighbour firstly.my bins are never left out mainly for that reason.

Can u not claim off his house insurance or something? Or claim off the council? I'd contact citizens advice to see if u can claim

My guess is that any insurance company would class that as a " act of god ".

yeah I think I will struggle,
Neighbour parks on his garden, doesn't have a proper driveway with no dropped kerb, so im going to wait until his car is in there and park in front of his "entrance" until he pays, ill use my bike to go to work

Legally he's not allowed to park on his garden if there's no dropped kerb, it means he has driven over the pavement.
If your friendly with any local coopers they can put a ticket on the car, or call the council or community police and they will ticket it.

Happens a lot on the street I live, we have the little green recycle boxes, when it's windy they all blow down the street along with all the recycling items they contained.
I have about 20 boxes round the back of my house that have landed on or near my property, maybe people will learn not to leave them out overnight in the wind if they keep going missing but maybe not.
Lucky for me nothing has hit my cars, hope you get it sorted ok.

managed to get most of the wing back in shape with a play at lunch time, small dent needs a paintless repair which ill get someone in to do, bumper has a small chip/scratch remaining after a polish,
Headlight is broken at the mounting though and its £728 for a new one

Post up a pic of the headlight as i repaired my headlight mount on my 135i with my plastic staple kit, it melts hot rods of stainless in to the plastic.

Quarry motors will sell you a part off a damaged 135i. Shame it wasnt the rear as I have 2 spare rear lights in my gargage.

In my old house where i used to park my cossie the lesgbions used to put there wheelie bin right next to the car. One night it was windy as fook and blew over on my car. I soon went out and booted the bin.

I wouldnt be happy at all James

His argument is that its not his bin its the councils so its up to them, even though he put it there knowing full well how windy it was?
For that reason alone i think it is his fault, he put the bin there. You can't change the weather but you can stop being a fucktard and open your eyes and use the thing in your head.

If i was to go into his porch, take a pair of his shoes and go and kick the shit out of his car, would it be his fault because its his shoes?

Because thats pretty much what he's saying, even though it was his actions that caused the damage, if he hadn't put the bin there the car would still be fine, he wants to shift the blame onto who owns the bin

I've helped him out a few times in the past when his car won't start etc, from now on the nob can piss off, I'm gonna make his life as hard as i can after turning away from any responsisbilty.

That would be my solution, help you get it fixed and shoulder some cost. If they understand a light is 700 but can get for 100 from breakers then fair to suggest that and pay the 100 at least and then find a solution for the bins.

You can get metal posts etc to secure them.

A simple, sorry goes a long way but in the PPi blame culture we are told not to admit any fault.

Yeah to be fair If my neighbour said "oi your bin has blown onto my car and damaged it" I'd be gutted for the neighbour and say I'm really sorry mate I didn't think when I put the bin out that it would get blown over. If he was polite like that then fair dos if u haven't got the £1000 to repair it (who has these days) then it'd have to be claim on insurance time, after all that's what insurance is for unfortunately :-( life's way too short to keep on at it, if he's being a cunt then I'd never help him or speak to him again. Either that or if I was that angry Id pick up his wheelie bin and throw it through the back window of his car

Have a look on your local council's website. Ours clearly state that,


Make sure:
  • your bin is placed at the edge of your property, at the kerbside with the bin handle facing out towards the road
And


Make sure you put your bin / bags out at the kerbside before 7am on the morning of your collection day


So if he put his bin out the night before, it shouldn't have been there. Maybe a case for the small claims court?

Even if you took him to court and won, he'd just do a fly by night when the baliffs come. See it loads round my way, they come for a few years, ring up 10's of thousands in debt, dont pay rent for a few months, then fuck off home again the night before eviction at like 2am

How is the night before not complying with this?

I think it's just one of those things mate. If anything, try the council. I'd be trying to repair the light - for that money there has to be something someone can do for a mounting.

Bit of a bummer indeed, but I don't think you're helping much by quoting £768 for a new headlight!

Why not just consider how much you'd get a good used, genuine one from bmw dismantler for?

I had a quick look on ebay and even an adaptive, xenon one is £349. Surely you'll get one for that or less depending on what type of headlight it is.

If someone came to me and said your bin has broken my headlight and I want £768 for a new one I'd just think they were trying it on.

I think you've worked yourself up over it, I understand it's gutting and all that but maybe a different approach might help.

It does NOT say:

"No earlier than xxx time/day"

It's not reasonable to expect everyone to get up and put the bins out prior to 0700. That's why half the planet will put them out the night before, and the council be perfectly happy with this.

I have seen councils say no earlier than maybe the lunchtime prior, just to make sure they are not out for days before. Usually in places where pavements are really small.

Collections start early in the morning, so we recommend that you put your bin out the night before your scheduled collection day

That's how much the light costs, I don't want second hand shite on my car that was mint before his bin attacked it, why should I? That's just the light, what about the other damage? It's not my fault its costly to fix.

It wasn't glued and bodged up when I parked it last night, so why should I be prepared for it to end up that way now?

Put the bin through his windscreen and tell him it's ok the council will pay for it.
