I can confirm that I was involved in an rta when a stupid cow decided to change lanes and moved from stationary traffic into my lane and hit the rear three quarter panel.

The insurance said 50/50,I said no way jose.

I did an aerial map showing my direction of travel (in green) and her trajectory (in red) just as an additional psychological indicator.

Her insurer backed down. Her fault.

seem pretty clean cut to me, dont let the insurance take the easy route as it is you than will end up paying in increased premiums and excess etc.

If you had both been traveling around the island and collided then it would be harder to prove who hit who, but as she has gone through a give way and into you path, and hit you rather than you hit her, her fault.

Thanks guys.

Injury claim forms sent off, a total of around 35 pages, forthe injuries i have and what ive seen and heard others get i can't see me getting more than 2k though ive now got to have psyhio cause my back has totally seized up, and not only have i sent in multiple diagrams annotated from different views, ive also included pictures of my vehicle and road furniture i struck because of her during the accident, just so they fully realise the situation.

I may have gone a little overboard with info and pictures but the way i see it is i give them as much as i can they cant ask for more and hopefully when they see it they will understand im a guy who doesnt cut corners and mess about with things like this.

personally, i'd be seeking proper legal advice, and getting them to deal with the paperwork and that sort of stuff.

you've got good grounds for a serious claim, someone with the the correct legal knowledge and who knows the system inside out will get you everything you're entitled to quicker and easier then you will yourself.

Based on recent experience with my own insurance company who did fuck all for me in a non fault accident about a year ago

Next time I really would get one of those accident management companies involved. Crash, RAM etc etc.
No way should I have spent the hours I did sorting out stuff when my insurance was supposed to.

Will do chap. Going to call up maybe Monday if there open failing that tuesday and see about getting the car back home and see if i can make any money from it, if theyl let me have it back that is.

My brother had a crash on a roundabout and he got told ALL smashes on roundabouts are 50/50.
