Default Parking the con !

I received a notice of parking in a loading bay today
Was not to sure why the picture was not right as it was only showing the rear plate up to the roof (not the whole car in the loading area were the offends was meant to have been committed)
Right so in the picture is only showing part of my car with brake lights on and the wiper blade not in the ignition switched off position would mean the car was running

So my point is one the car was not parked
the car was not unmanned
the offence could not have been made

Why are the making false claims !
i am sure if the car was not in traffic it would show the whole car and the offence
any feedback ?

I had the same a few month's ago and on Sunday i am disabled too with my sticker on the dash board i had to pay Ł30 fine because your not allowed to park there i said it was Sunday does n't matter there reply

If it is a council ticket then pay it and forget about it. The hassle it will cause you going through appeals will far outweigh the cost of the fine.

If however it is a private firm, then bin the letter. You may get a few more threatening letters but they don't have a legal leg to stand on. I've been caught a few times now by private firms, bin the letters and it has never gone any further.

council ticket, ask for the complete pic of your car "parked" and a ticket on the screen

got a ticket yesterday on the van, but i got back just as he was writing it out, so when he went for his camera, i simply removed it from where he'd tucked it under the wiper

and then i drove off

i'll wait and see what happens

Was done by CCTV so would have been able to show the car the offence and street even but have not will post the picture

if the brake lights are on then the driver is still in the car and its not parked. most likely the engine is still running too. don't think they have a leg to stand on and only showing part of the back of the car would not constitute evidence as the car could be anywhere!

load of shit really probably from a private firm trying to scare you into paying.

As above mate, tell them to ram it. The photograph described does not constitute reasonable evidence. Contest it on the grounds stated. They should quash the fine.

You'd be amased how many tickets that have succesful appeals. I've had a few with work and have always had them overturned.

A recent "legal" definition was determined as a car is parked even if the driver is in the car, if it was somewhere it shouldn't have been.
The easy defence to this is that someone was bringing a parcel to your car from a nearby shop etc.

Also just thought one of the civil right are that if you are seen on cctv you can ask for a copy
so if i request this from the council can prove them wrong !

Just uploaded the paperwork and noticed the picture bottom right has a yellow line in it loading bays don't !

If there was no 'No Loading' marks on the kerb, and you were actually loading - send them a copy of the delivery note, or a note from the company to prove you were loading, and they'll drop the ticket. Worked for me a couple of weeks ago

Meant to have my appeal on thurs at 3pm and got a phone call saying they withdraw the case
i won just goes to show i was right !

Good. Used to cause me loads of problems when I was doing parcels, not being able to get in to a loading bay because blue badge holders were parked in it. You all seem to think a blue badge gives you carte blanche to park where you want, but you soon kick off if someone blocks your disabled bays to do a delivery....

it is a common misconception that disabled people are unable to park in loading bays, its not the case.

btw, i am not a disabled driver hung up on the law, i work in highway law

the terminology in the Traffic Regulation Order for this 'should' have said that 'no person may stop or wait'

as a result whether you were in the car or not would not be cause for appeal.

HOWEVER, well done on getting off
