Just got an £80 fine off the DVLA

In febuary my car got wrote off and i sent the documents to the insurance company in the manner they asked them for as i wouldn't have been payed out. I have had no corrispondance from the car since then i get a letter stating i have a fine for not delaring it sorn which is reduced to £40 if payed in a certain period ![Bat](https://passionford.com/forum/images/smilies/pascontent.gif)
So then the dvla tell me i will recieve another £40 fine for not informing them i was no longer the keeper of the vehicle i aint happy so i tried to claim the £80 from the insurance company and suprise suprise they don't wanna know so then i said right stick the policy up your ass i'm cancelling it so they then told me if i do that i will have to pay a penalty clause or the full amount of the policy and if i refuse to do that they will take me to court to recover the cost of my claim![Wall](https://passionford.com/forum/images/smilies/wall.gif)

Have you explained this to the Dvla in a letter?you may well get a refund if the cars been written off as theoretically you'd be breaking the law to sorn it yourself as you don't know where the vehicle is should they want to inspect it therefore you personally cannot declare sorn.

Have you got copies of the letters from the insurance company?
Send them to the DVLA and tell them that the insurance company are your appointed agent in respectof this issue and that they became the owners and liable party for the vehicle on date xxxxx..... If they come back to you then let them take you to court IMHO.

I had a proton last year, it was m.o.t'd for 3months, me and the mates wrecked it in the and then had it scraped, never decared anything, haven't got any letters demanding tax etc

Their trying it on right now when they can't seem to get the full sorn fine out of people.I had one of these for my astra gsi,phoned them up ranting and asking how the hell was I responsible for them not recieving my v5 as I'd sent it off and they said that if I hadn't recieved confirmation within 6 weeks I should contact them yet when I had a speeding fine through for a car I no longer own the other day I wrote them a letter saying that it was sold on x date and they responded saying thankyou very much,no fine,nothing???!!???
Also,did u know if you get a sorn fine they say on the letter that you should pay the back tax of x amount (usually about £30 or so).you don't actually have to pay that,you're only obliged to pay the £40 sorn fine,this was confirmed to me before by phoning the Dvla and questioning it,the girls response was "it's optional if you were keeping the car on the road for that period of time",which would never happen as it would have been towed away!!!

Numerous phone calls to DVLA couldn't resolve shite so ended up paying them the 40quids and wrote a letter telling them to take the car of my name

You must inform dvla of change of ownership be it an insurance company or whatever-if you dont tell them who will???
The insurance company wont unless you fill the forms in then the car is not legally yours
just like selling it isnt it-
if you sell the car and dont do the paperwork and the new owner goes through spec or other forms of camera who get the fine????

Do YOU deliver any letters personally to the DVLA ?
In which case as has been tried much recently by DVLA, they have to legally accept peoples claims that they posted out said items to them, maybe you just " forgot" that you did write to them.
This has come about due to the amount of mail being lost, and the many many cock ups by dvla, well publicised.
I think you fogot and did indeed send off the papers to dvla, tut tut bad memory you have.

tell the dvla that the insurance company removed the car from you and took the log book
you've sent off a letter to them informing them that it's been written off and, seeing as you have had no further corespodance form them you consider the matter closed
if they want to take you to court you can tell it to the judge and you'll win
there have been several cases now where the dvla have lost and it's only by them sending out letter from their late licensing penalty office that they get the money
even a letter from teh dvla stating that they have recivied confermation that the sorn was declared won't stop the llpo from wanting their money as they are a totaly different organisation to the dvla and only share data, so the fact that there has been an internal cock up in the their offices shouldn't mean that you have to suffer as a reslut
