Default bus crash

hi 7 mths ago i got took out by a bus and still waiting for them to pay for the damage what im asking is where do i really stand as this has been taking some time now do you think there gona pay out for this as the driver admitted to hitting my car but at the time he wouldn't give his details to me .
so i left the car in the road still no details i have a few bits of evidence and a total cost of repairs estimate ..,
any ideas guys

waiting for the bus company they sent me forms to fill out so done that but had no reply im lost in the system

I would phone your insurance up and see if they can sort it out, no way should it take this long to sort out

if you have paid for the legal aid as part of your insurance ring your insurance company and let them deal it that what you pay insurance for, what you must get is proof that the driver admitted liability as if he gone back to his bosses and they said don't admit to anything you will struggle

The bus driver should of gave you his details he should be sacked for not doing it is after all a criminal offence all as he would of needed to give you was his staff number bus number and his company's details upon his refusal you should of considered phoning the police.

I know bus companies have large excesses our companies is Ł50k usually our company will have the car repaired within a few days as it aint worth the aggro with insurance companies for a mirror or a scrape

bus companies put up a bond of a few milloin Ł to cover themselves and don't actually have any "insurance" with a company

they pay out of their own pockets so they defend to the hilt any claims against them as they have to pay out of their own pockets/budgets

go to your insurance company and tell them

the driver doens't legally have to give you anything other than his name and point to the little sticker on the side of the bus that tells you who it belongs to

you have taken good pics though of the bus number, the reg number and the driver so they will be albe to find out who it is

what you should have also done was found out what his route number was, normally displayed on a card in the windscreen so that they can place the bus and the route at that particular time and find out who they paid to cover that route

Ł4 million bond for us

and the police won't turn p to an accident unless there is an ambulance on the way as well

The bus company I work for has a policy which is TPFT only with Ł500,000 excess.

The driver does NOT by law have to give you his name or number, the fleet number or Reg of the bus is all you need.

Arriva are a faily big company and they should have paid up by now. I would pass it on to a solicitor to chase up they will more than likely be hoping your going to just forget about it.

we don't have to give our name we give a blue slip with our staff number bus number on it and that's it. We collect there name address phone number car details then any witnesses details we can obtain.

different companies have diferent protocols, but they are essentially the same

as long as you identify yourself in some way that's enough from a legal standpoint, and accident forms of some description are what most of them use nowadays

there are ways around it if you haven't been seen behind the wheel, but seeing as there is photographic evidence of the deed and drive in question that's a moot point

tell them you want to talk to some one about a accident involving one of there vehicles.

when you speak to them explain when it happened and that the driver admitted it at the scene - ( even though any admittance of fault at a scene will not stand up in court )
tell them you have pictures from the scene of the vehicles / the driver and that you will be contacting a credit hire company.

i would think that arriva have a accident management company that try and capture there third party repairs like we do for several large companys and police forces.

you need to be on their case.

Make sure you have a note pad with times and dates and details of the accident, and times and dates and contents of calls or letters and names.

Have these to hand and ask them what they are going to do about it. See what reply you get and if they are still trying to fob you off then I would speak to your insurance if they still want to know.


I got paid out in about 10 weeks, more to do with my insurance being shat than the bus company, in the end i told my insurnace that if they messed about and lost vital cctv evidence that they may need to reply on should the bus driver deny responsibility due to not getting their finger out then they would be paying for all damages due to their incompitence. Not sure if that actually did anything but things moved pretty quickly after that.

Also had a case drag on for THREE YEARS!! in the end I wrote a stern but fair letter to the the director of the solictor firm dealing with the case stating times, dates, names and what has or more to the point hadn't been done. Posted on a Friday and mid morning monday my solicitor (who had been blanking me for months) was on the phone like he was my best mate. That got resolved within a month after that, they admitted they had left it so long the other party had closed the case!!

well i gave them a call they cant find any info on the data base so ive asked them to send a new claims form hope i done the right thing

You can't by law directly take a photo of him, it is dismissable in court.

However you can take a photo and just happen to catch him in nthe background,

work that one out
