Default Noise Pollution

Just got pulled over by some copper in a riot van type thing and he was going to give me a producer/rectication notice for my exhaust being too loud

Thing is he didn't have the documents, but said i can't drive my car until it's got a road legal exhaust on it, although he can't prove it's not road legal.

What can i do?

To make matters worse he calls this my 'lucky day' Tosser.

get some proof your zorst is road legal then when he pulls you over next time say this is YOUR lucky day, look what I've got, you can then give it to him and politely tell him where to shove it

You need somewhere to measure the db from the zorst, not 100% where you could get this done, needs to be measured from a certain distance as well.

I spose a car audio place could measure it with the right gear? Need to find the distance it needs to be measured from as well though. As to what else a zorst needs to be road legal I don't know, can't be much...

What can you do when he says he doesn't want to see the car again? other than tell him to close his eyes next time her hears it.

Never had any problems with police regarding exhaust noise before, just this one **** who said he could hear me all over town this could be the fact that he was following me through the town.

xr craig, not saying you have.... How many of us have probably p*ssed off an off duty scuffer? Overtaken one at full chat, drowned out his 'Jazz Fm' with some humming bass lines? Well, some of us, ahem! He's got your card marked for one reason or another. If all he could winge about was your exhaust i wouldn't worry too much.
There is a Ministry Of Transport web site, which will have the applicable figures you want. Try Maplins, or the like for a Sound Pressure Level meter about Ł20. That way you can test your car, if you fall under the SPL level, carry the meter in your car, if he scuffs you again, you can perform the test for him. Can't say fairer than that ( what a friend of mine used to do with his 100E ).
British Kite mark, hmmm, so what if you had a custom silencer made for your car? Me thinks he's clutching at straws on that one .

I have been done for excessive noise from a motor vehicle when I had my Cossie.

And any aftermarket exhaust is illegal

Never heard of the BS mark on car exhausts but all road legal bike exhausts must now carry a BS stamp.
There's a healthy trade in BS plates to stick onto race cans!

Section 163 Road Traffic Act 1988 gives Police the power to stop all mechanically propelled vehicles on roads. It's an offence not to stop.

Section 67 gives authorised Constables the power to inspect vehicles on roads. It's an offence to obstruct an authorised examiner.

Regulations 54 to 59 of The Road Vehicles (construction and use) Regulations 1986 cover all the offences relating to the use and maintenance exhausts & silencers, including various EEC directives and British Standards which set out noise limits for various types of vehicles (complicated depending on when your vehicle was built etc).

Reg 97 creates the offence of excessive noise ie "No motor vehicle shall be used on a road in such manner as to cause any excessive noise which could have been avoided by the exercise of reasonable care on the part of the driver ."

An authorised Constable can stop you and test your vehicle for a noisy exhaust or any other defects. He can also use measuring equipment if he has it.

cheers, he didn't test it or anything. And he had no other problems with the car.

Spoke to my dad about it and he says just igonore him and drive round in a higher gear than usual, chances are he's just being arsey and picking easy targets. Which is something the police around here seem to do to avoid any hassle from people who are actually causing a distubance

aRSe - know what your saying matey. I can kinda see why now, i think i may have been making more noise that usual because i was in second for a little longer than usual while i was scratching my ankle. But i wassn't doing anything wrong other than that and i normally try to be as quiet as possible.

Ah well, not a problem anymore. Just wait and see what comes of it all.
