Default Reclaiming bank charges - Anyone had any success?

I've just got my statement it from HSBC, and had another £55 charges in total for this month every month theres more and more charges going onto my statement, i'm not working much at the moment, and i really could do without an extra £55 making its way magically out of my account. the anoying thing is its only for "silly" amounts at one time, like £6 overdrawn, £24 overdrawn at one time, then i get some cash in and stick it in the account to keep my insurance money coming out to make sure it stays valid etc but the way it is, i'm working a few days a week, then money in and its just covering my account back to zero as i keep getting charged.

I've been on moneysavingexpert.com and downloaded the template asking for the last 7 years of statements so i can work out how much to ask for. BUT has anyone been successfully through the process? I have no loans with them, no credit cards, and am not too fussed if they want to close the account on me, i have a building societey account with the Halifax from years ago which is still active.

Any help greatly apreicated, like any ideas on timespan, if it costs anything, will they take me to court over it? etc.

i did it successfully.. got a fair few quid back but that was a couple of years ago at least. i think the banks are putting up more of a fight now - possibly due to a court case or some change in legislation.

edit to say the whole process took me about 6 to 8 weeks iirc

Cheers for that, i can handle 6-8 weeks, but i think i'd go mad it it were 6-8 months.

i'm going to send off the letter asking for my statements, and go thought the motions at least.

Last I read, it was put on hold pending a court case outcome that could possibly take years to sort out. Not sure how true that is though ...

Yeah it says that on the website too, but i'm hoping that i can class for financial hardship as it says, As i'm not on a regular wage and havent been for 3 months or so.

mrs did hers a few years ago got quite abit back didn't take to long, think its alot harder to do now

I have been waiting about 2 years now for the courts to come up with a decision.
basically they decided that the charges are classed as unfair but the banks keep on appealing and have taken it to the house of lords despite the fact that they were told they were not allowed! all the while that this is going on there has been a hold in place to freeze any claims.
apparently the final decision is on its way after the lords final ruling last month but as of yet nothing has come through.
in the last 2 years i have had about 3 letters from HSBC to let me know that my claim is still being processed but obviously not until the hold has been withdrawn. Best thing to do is go onto moneysavingexpert website and sign up for the free newsletter as any news is usually posted on that every week!
tis a bit of a jip though. how would the banks feel if everyone who has been waiting just decided to charge more interest for the two years we have been waiting! they charge it so why cant they.

only way round this is if you are in some kind of financial hardship (lost job, low income, morgage and cut wages etc) then you can write to the financial ombudsman and can try to sort it from there.

Moneysavingexpert has all the answers to your questions though but get your claim in and join the Q sooner rather than later!

thanks for the above, as said it would be nice if i can get into the financial hardship bit, but tbh i have no real commitments, its just that i'm not working and have no money in the bank, as said i'll work a day or three in a week, get paid for it the next week and it pays off my overdraft from where the bank has charged.

i'll put my name down and get in the queue though thanks .

I got in just before the deadline and managed to scrape £1100 iirc back from Barclays. Last I heard it was pending a test case which the banks lost and appealed. Not sure where we are now

Thanks again for the input.

i think i might have missed the boat slightly on this one, although i do know its been around a few years. i'm going to request the statements tomorow, and put my name on the list, i've nothing to loose at least... i think i just hate the thought of giving the bastards another £25 overdraft fee. £25 goes a long way for me at the moment.

I got my mrs nearly 4k back, but again was before the big stop, also I got 3.5k back , was terrible with cash as a youngster!

Don't forget you get interest of 8% , so a £30 charge 6 years ago is worth almost £80/90 if you get the claim settled...

it all got put on hold because of the recesion, though it was the banks that got us in this mess in the first place....

how can that be right?

i went over drawn just before Xmas, a couple of years back,
as i had Mot, 23rd dec, went over £6, they rung me on boxing day, was away with folks, genuinely didn't realise i was overdrawn, got back i think it was sat, a week later
3 letters on the door mat, and because of the days i couldn't get down to the bank to put some money in, and it went round into the next month total charge was £186.

i started to claim about 18 months ago about 4 days before they brought the ruling in,

and its got really flat since.


and yep i'm with HSBC

Haven't had bank charges for years, but the last time i did was when all this reclaiming nonsense kicked off, i just went into my local branch and asked them to refund me, and they did, without so much as a sigh, i was shocked how easily it was. Better in your pocket than theirs.

halifax wont take anymore claims until the court case is done, im leaving them anyway coz there gona be charging £1 a day to use overdraft!!

Seriously though, if i've gone over before its been my own fault, gone on the piss mid month, bought some shiney parts for my car etc etc, but when i've very little coming in now every week, every penny counts and it'd be nice to have some slack!

I got some back but must be nearly 2 years ago, that was with Halifax.
I had to change from these owing to the fact they refused to give me my money, all cleared and everything, the police were called as I refused to leave until I got the money, mine from my account that I asked for, they wanted me to show them "evidence" of where it came from wtf!
Now with Natwest so much better.
