Not Really. But i am sure that they need to be following something. Nice one Warren, i'm gonna look into that.

The whole bust thing with Solicitors doesn't work. If you were to withdraw and go to a different one, you have the added stress of starting all over and again and to top it all off you have no idea if the new solicitor is going to become a lazy cunt like the last. Its just a pain. Ours took 15months before we got the Key to the house. BASTARD!!!

Well, just been on the phone to our solicitors and he has come in to the office as he was supposed to be on holiday!! Unfortunately my buyers bitch, sorry, solicitor has raised 25 queries again!!!! 3 fookin days before the planned completion!!!!!!!!! Most of them are to questions i've already answered FFS!!!

And so it goes on and on and on and on and on........................

Once it is all done i'm going to look into having something done about his solicitor and report her for incompetance!!!

Give them till 4pm and then tell them you will be popping down regardless tomorrow and your not leaving till everything is in place for Friday. If she doesn't want to complete it in a day, tell her tough shit. Its been 18 weeks. If in 18 weeks she hasn't done what could be done in a day, then you tell her come tomorrow your gonna take a seat in her office and she's going to get it done

Damn right.

I swear ALL solicitors are crap! Example, our new house. Cash purchase, no chain, nice and easy you'd have thought. Local searches too nearly a month to come back cause the fuckwits sent it off to the wrong place. A day before they came back, I found out that I could have drove down there myself and got them done. If I'd have known that....

Hopefully won't have to do it again anytime soon. The only solution is to phone them on the hour, every hour, or failing that turn up on their doorstep.

It's not our solicitor who is causing the problems it's our buyers solicitor so we can't go down to her office and demand that she does anything.

Our solicitor was supposed to be on holiday from today but he came in as he must have seen then additional information that our buyers solicitor wanted so he wanted to make sure that everything was done so that nothing from his side would hold up the completion on Friday.

To be honest our solicitor has been spot on, its just our buyers solicitor that is being a numpty

Scott has been on the phone to our buyer today and he's under no illusion as to how important it is to complete on Friday. But if there's one thing that I've learned throughout all of this is that you can't trust anyone.

People will tell you a whole host of bullshit just to get you off their back so there is no way of knowing if what our buyer is telling us is the truth.

For example, our buyer is now saying that his bank won't release the funds until they have the FENSA certificate for the new windows we had fitted. Now we know we can take out indemnity insurance to cover the windows not conforming to Building Regs which is what we had planned to do but is he just saying that as a stalling tactic? Who knows He says that his solicitor spoke to his bank yesterday and that is what the bank told her. He supposidly went to the bank on Monday to sign the transfer documentation to release the funds to his solicitor and having not received them his solicitor rang them to ask why and thats when they confirmed they needed the certificate.

Now that doesn't ring true to me because surely his bank would have told him that they needed the certificate before they would release the funds so it shouldn't have been a surprise to him that the funds hadn't been transferred.

So the saga continues, either way our completion isn't going to happen on Friday, I'm certain of that. If we can exchange then we might be able to appease our seller but even then they might just turn round and say fook off!!

I seriously can not go through all this bullshit for another week

Thanks Helen, but you know when you just have a gut feeling that everything is going to turn to shit.

He is actually right about the FENSA Certificate. The banks are abit cuntish like that. When we bought the house, HSBC wouldn't release the funds until they had that certificate. They want the windows to be to Building Regulations.

The windows, are they the main house hold windows? or is it for a conservatory?

From what my old man says, if its been replaced after 2002, you (as the seller) will need to provide the FENSA certificate (or a local authority buildings control certificate).

We know he's right about the FENSA certificate, thats why we have arranged indemnity insurance to cover the fact that we don't have one. Our solicitor has arranged it today for us.

The windows are for the house and they were fitted in 2005 I think.

Then you are ready. I just asked a friends aunt who is a mortgage adviser at Natwest. The buyer just sounds like he's being a Cunt. She says the insurance is enough for the transaction to happen today.

My mates aunt was the one who sorted our funds out when she was at HSBC so i know i can trust her with what she says.

Tell Scott to call him (and don't get angry at him lol) and ask the buyer to stop with the BS and what the problem exactly is. The fact that you have the Insurance there is nothing to obstruct it any longer. If he mentions the FENSA again then he's just being a difficult cunt and doesn't know what he's doing. His bloody solicitor should know all this and i personally think she's just stretching the days to make a few more £££ as many are known to do that. Especially when Scott and Yourself know that it can be completed today with a little extra work on her behalf (which if i recall Scott said she's being a lazy bitch and not wanting to do the Extra work)

His solicitor has taken today off so can't be contacted. She only works part time and she usually has Tuesday and Thursday off so it's doubtful whether she will be in tomorrow which leaves us in limbo for another day.

Our solicitor has sent back the responses to her 25 queries (which we have already answered previously ) so if she is in tomorrow she will be able to look over them. I'm guessing that she still won't be satisfied and some more points of clarification will come back which will drag it out to Friday so no chance of completing. That's if she is even in tomorrow.

On a plus point, my passport turned up today so at least I know that I'll be going on holiday in September, every cloud.......

In all honesty tho hun, seems like the buyer and solicitor is taking the piss completly now, and I know when I worked in a solicitors, they always passed their work onto other solicitors to be completed etc on their days off, so seems this one just aint doing that

Yes they are..... the Solicitors Regulation Authority..... however, unless the solicitor in question has done anything negligent, it would be pretty pointless complaining.... I am sure with the amount of mortgage fraud the SRA are having to deal with it at the moment, they have enough to be on with.

Good News on the Passport. I was supposed to be in Los Angeles for my 23rd and BA and Virgin refused to sell me tickets because of the swine flu crap. So i haven't had a holiday this year and Uni starts again in September

All good firms follow it, and if they don't they are probably the likes of the many dodgy named firms who have recently committed mortgage fraud with countless people with dodgy names...

At the end of the day if a solicitor's client is being awkward and wants to stall for time, there is nothing that solicitor can do.

True but even some of the top firms can take the piss. Once they sucker you in with what they can do for you, the fuckers stop answering calls. You can never put your full trust into them.

At the end of the day if a solicitor's client is being awkward and wants to stall for time, there is nothing that solicitor can do.
In this case I think it's a bit of both, the client (our buyer) and solicitor are both taking the piss.

His solicitor told us that it would take a minimum of 2 weeks maximum of 3 weeks to complete the purchase. It was 3 weeks yesterday and she hadn't even looked at the contract, she also asked a further 25 questions yesterday which we have already previously provided answers for and have provided the documentation for where it was available.

We have repeatedly asked her if her client was 'in funds' to ensure that we wouldn't have an attempted gazunder again to which she replied.... "my client assures me that he is in funds" I'm sorry but "assures" isn't the same as saying yes I have checked with my clients lender and the funds are available for the purchase.

One of the first things that our solicitor had to do was contact our seller and tell them that we had the mortgage offer in place and we were in a position to proceed.

If somebody asked me at work to do an urgent job for them and if they asked me to given them a deadline of when I could complete it for I wouldn't say I'd do it in 3 weeks if I wasn't going to be able to meet that deadline.

It really does infuriate me, especially as both our buyer and our solicitor know how important it was to get this through ASAP.

This is why our house buying system in England stinks. We have spent nearly £2.5k on solicitors fees in the last 17 weeks and if everything goes tits up we can't get any of that back!

Sorry another rant, I think you can tell that I'm a tad upset about the whole thing
