Default Making a claim.

Today someone knocked my wing mirror off. It was their fault as they were on my side of the road, they also admitted fault. We exchainged details and he was told I would be making a claim which was fair enough.

My question is, do i contact his insurance company to make the claim or go through my own? Im worried it might affect my insurance premium in the future even though it wasnt my fault.

you could contact a non fault company like accident advice helpline they will get your car repaired and will sort everything out without the need to contact your insurance company...............hope this helps......

If it's their fault your insurance isn't and won't be affected. For a mirror I'd personally just get the cash off him and sort it myself.

just contact your own insurance company. SO long as it's non fault they won't load your premium.

He wouldnt cough up for a mirror as i know they range from Ł50-Ł75 + postage and thats 2nd hand, i would need to have it painted on top of that!

for your escort? wont you be able to get another from a breaker for Ł25 or so? i wouldnt be bothering with the insurance for just a wing mirror. you should have taken some cash of him at the scene so he'd hear no more about it.

i would be on the phone to his insurance and tell them you wish to make a claim agains their insured, they will then send you a claim form or do it over the phone and tel lyou to get a quote for a NEW mirror and supply them with the quote. Dont be pushed nto taking it to their approved garage either tell them that it is going to be done by BMW (do you have all your work done at BMW or does it have any BMW history with it? as that will provide more leverage against them if they get funny)

Just roughly priced it up and it could be as much a Ł400 for the mirror complete, then painted and fitted!! WOW

Exactly my thoughts, for the sake of 100-150, its better to cough that up than to faff around with insurance companys, and also lose your no claims etc and put premium up, im sure someone on here said even if its not your fault you still get raped for claiming

Sod him then. Speak to your own insurance company, they're usually pretty good and will probably take it up on your behalf.

One of the things about insurance is it is a contract, they have a LEGAL obligation to pursue this matter, but if they choose to do nothing, they cannot load your insurance, but may choose to pay you themselves for this small amount, they can only do this with your permission however, otherwise you can force them to pursue other party.
Don't phone other insurers, the man will no doubt "change his mind" about whose fault it is.
The reason why your insurer may pay you is because it is vastly cheaper than litigation, at Ł300 a letter, then they have THREE months in which to reply, so all very long winded, they say not us, your insurer counterclaims etc etc, 2 years down the line you might get somewhere, but likely with no witnesses(?) it will be settled by each insurer knock for knock, with each paying thier own bills.
The other shortcut, if you have evidence(witness) of fault is to write to him ask him to pay, get repairs done, if he doesn't CC him, as his insurer WILL take notice of a county court summons!!

did you get it in writing that he admited fault?

if so, call one of them claim help companies to avoid going through your insurance company

just DON'T take up their offer of a replacement hire car because if it all goes tits up you are liable for the costs of it

Think ill just contact direct line who im insured with, after all i do pay them every month so its about time they did something for it!
